HomeMy WebLinkAbout1985-07-09-Ordinance 2050_Rezoning, Unnamed PropertyORDINANCE NO.~L)E)~ AN ORDINANCE AMENDING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY LIMITS OF WAUKEE,IOWA,FROM C-2 (CENTRAL BUSINESS DISTRICT)TO R-4 (ROW DWELLING AND CONDOMINIUM DWELLING DISTRICT)AND PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP AND THE REPUBLICATION OF SAID MAP TO REFLECT SAID ZONING CHANGE. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Property Rezoned. A.The zoning ordinance of the following des- described real estate shall be changed from C-2 (Central Business District)to R-4 (Row Dwelling and Condominium Dwelling District): "The South 42 feet of Lots 1,2,3,and 4 in Block 7 of the Replat of the First Addition to the Town of Waukee,Dallas County,Iowa,and All that part of an irregular shaped tract of land that lies South of said Block 7,in said Replat of the First Addition to the Town of Waukee,and North of the Northerly Right-Of-Way Line of the Chicago and Northwestern Railroad which is more accurately des- cribed as follows:Beg inning at the S.E.Corner of Lot 1,Block 7,in the Replat of the First Addition to the Town of Waukee,said point being 16.0 feet North and 80.0 feet West of the N.W.Corner of Lot 8,Block 2,in the Original Town Plat of Waukee,Dallas County,Iowa,thence N90000'W,along the South line of said Block 7,in said Replat of the First Addition to the Town of Waukee,285.0 feet,thence S59°51'E,along the Northerly Right-of- Way of the Chicago and Northwestern Rai lroad,as it is shown on the Original Town Map of Waukee,Dallas County,Iowa,271.42 feet,thence N OOlO'E,along an established Chain Link Fence fence Line,128.32 feet,thence N 90000'E,parallel with and 8.0 feet South of the South line of said Block 7,in said Replat of the First Addition to the Town of Waukee,50.0 feet,to a point on the West Right-Of-Way Line of 5th Street,as it is presently estab- lished,thence N 0035'W,along the West Right-Of-Way Line of said 5th Street, 8.0 feet to the Point of Beginning. Said Tract of land lies in the NE 1/4 of the NW 1/4 of Section 33T79NR26 West of the 5th P.M.Waukee,Dallas County, Iowa.Said tract of land being subject to and together with any and all easements of record." Section 2.The official Zoning Map shall be amended to reflect this change. Section 3.Effective Date.This ordinance be in effect after its final pasage,approval, publication as required by law.
