HomeMy WebLinkAbout1981-08-10-Ordinance 2001_Parking RegulationsORDINANCE NO.2001 AN ORDINANCE TO AMEND CHAPTER 502,WAUKEE MUNICIPAL CODE,PARKING REGULATIONS OF MOTOR VEHICLES WITHIN THE CORPORATE LIMITS OF THE CITY OF WAUKEE,IOWA.BY REVOKING CHAPTER 502 IN ITS ENTIRETY AND AND ADOPTING A NEW CHAPTER 502. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Chapter 502,Waukee Municipal Code, parking Regulations of Motor Vehicles within the corporate limits of the City of Waukee,Iowa,is hereby revoked and there is adopted in lieu thereof the following: PARKING REGULATIONS OF MOTOR VEHICLES WITHIN THE CORPORATE LIMITS OF THE CITY OF WAUKEE,IOWA §502.All references made to streets herein are to be construed to refer to the nearest right of way 1 ine of said street. parking will be allowed except as prohibited herein. §502.1.No parking is permitted at any time on either side of the following North-South streets: East Road First Street Second Street Third Street Tenth Street §502.2.No parking on the East side of the following North-South streets: Kaylin Drive Eighth Street Ninth Street §502.3.Regulations concerning the other North-South streets from East to West are: A.No parking on either side of 4th Street from U.S.Highway 6 South to the South side of Northview,except: (1)Angle parking will be permitted 142 feet North from the Northwest corner of Maple Street on the West side of Fourth Street; ------~--~~--~~ (2)Angle parking will be permited on the West side of Fourth Street from Locust Street 716 feet South. r-j B.No parking on the West side of Fifth Street south of Ashworth Drive. C.No parking on either side of Fifth Street North of Ashworth Drive,except; (1)Head-in parking is permitted on the West side of Fifth Street from a point 10 feet south of Laurel to a point 114 feet south of Laurel Street. (2)Parallel parking is permitted on the West side of Fifth Street from a point 10 feet North of Ashworth Drive to a point 75 feet North of Ashworth Drive. D.No parking on either side of Sixth Street except: (1)Angle parking is permitted on the West side of Sixth Street starting 123 feet North of Ashworth Drive South to North side of Locust Street; I (2)Angle parking is permitted side of Sixth Street 100 from Locust Street; on the West feet South (3)Parallel parking is permitted on the East side of Sixth Street from Walnut Street South 134 feet. (4)Angle parking is permitted on the East side of Sixth Street from a point 157 feet South of Walnut to a point 239 feet South of Walnut;and from a point 266 feet South of Walnut to a point 294 feet South of Walnut E.No parking on Seventh Street,except: (1)Parallel parking is permitted on the w.est side of Seventh Street from the South side of Maple Street to a point 122 feet South of Maple Street. // (~--------- (2)Parallel parking is permitted on the west side of Seventh Street from a point 10 feet North of Walnut Street to a point 40 feet North of Walnut Street. (3)Angle parking is permitted on the East side of Seventh Street from the South side of Maple Street to a point 142 feet South of Maple Street and from the North side of Walnut Street to a point 73 feet North of Walnut Street. (4)Head-in parking is permitted on the East side of Seventh Street from a point 15 feet South of the South Side of Walnut street to a point 70 feet South of Walnut street. (5)Parallel parking is permitted on the East Side of Seventh Street between Walnut Street and Cherry Street. §502.4.Regulations are: concerning East-West Street A.No parking on the South Side of Laurel Street from Fourth Street to Sixth Street. B.No parking on either side of Cherry Street. C.No parking on either side of Ashworth Drive. (1)Angle parking is permitted from a point 82 feet West of Sixth Street East on both sides of Ashworth Drive to the West side of Fifth Street on the North side and 121 feet West of Fifth Street on the South Side. G.No parking on the South side of Walnut Street,except: (1)As hereinafter provided in §502.5 re- garding regulations concerning parking in the business district (triangle).] (2)Head-in parking is permitted from a point 9 feet West of Sixth Street to a point 118 feet West of Sixth Street. (3)Head-in parking is permitted East from Seventh Street a distance of 50 feet. H.No parking south side of Locust Street. (1)Angle parking is permitted a distance of 134 feet West of Sixth Street on the south side of Locust Street. (2)Angle parking is side of Locust Street and Fifth permitted on the south street between Fourth Stree't. I.No parking on either side of Northview from Third J.No parking south side of Northview from Third Street to East Road. K.No parking South side of Waukee Avenue. N.No parking North side of Corene Avenue. §502.5.Regulations concerning parking in the Business District (Triangle)• A.Parallel side of South to parking is permitted on the East Sixth Street from Ashworth Drive Walnut Street. B.Angle parking is permitted on the North side of Walnut Street between West side of Ashworth Drive and East side of Sixth Street. C.Head-in parking is permitted from a point III feet West of Fifth Street to a point 138 feet West of Fifth Street;and from a point 162 feet West of Fifth Street to a point 183 feet West of Fifth Street. Method of Parking §502.8.Standing or parking Close to Curb.No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the right- hand wheels of the vehicle within eighteen (18)inches of the curb or edge of the roadway except as otherwise herein provided in the case of angle or head-in parking and vehicles parked on the left-hand side of one-way streets. §502.9.Standing or parking on the Left-Hand Side of One-Way Streets.No person shall stand or park a vehicle on the left-hand side of a one-way street other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the lefthand wheels of the vehicle within eighteen (18)inches of the curb or edge of the roadway except in the case of angle parking. §502 .10.Signs or Markings Indicating Angle Park- ing.The police department as traffic conditions re- quire,shall determine upon what streets angle parking shall be permitted and shall mark or sign such streets or portions thereof indicating the method of angle parking. Such determination shall be subject to approval by council resolution. 1 §502.11.Obedience to Angle parking Signs or Mark- ings.Upon those streets or portions of streets which have been signed or marked for angle or head-in parking, no person shall park or stand a vehicle other than at an angle or head-in to the curb or edge of the roadway or in the center of the roadway as indicated by such signs and markings. Stopping,Standing,or parking Prohibited in Specified Places §502.12.Stopping,Standing or Parking Prohibited. No person shall stop,stand or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control device,in any of the following places: ) / / ---~--------~._--------- A.In any public alley within the fire limits of this city. B.In any private alley within the fire limits of this city in such a manner that ingress or egress of fire apparatus to or from such alley might be blocked. C.On a crosswalk at an intersection. D.upon any street within the corporate limits when snow or ice removal is necessary. E.On the center parkway or dividing area of any divided street. F.Within twenty (20)feet on either side of a mailbox which is so placed and so equipped as to permit the depositing of mail from vehicles on the roadway. G.On any area of a street not improved,de- signed,or ordinarily used for vehicular travel,except as otherwise provided herein, in areas approved for parking. [1/12/82] §502.13.Authority to Paint Curbs and Erect Signs Prohibi ting Stand ing or parking.When,because of restricted visibility or when standing or parked vehicles constitute a hazard to moving traffic,or when other traffic conditions require the police department may cause curbings to be painted with a yellow or orange color and erect no parking or standing signs.It shall be unlawful for the operator of any vehicle to stand or park a vehicle in an area so painted or sign-posted. §502.14.Authori ty to Impound Vehicles.Members of the police department are hereby authorized to remove, or cause to be removed,a vehicle from a street,public alley or highway to the nearest available garage or other place of safety,or to a garage designated or maintained by the pol ice department,or otherwise maintained by the city,under the circumstances hereinafter enumerated: A.When a vehicle is upon a roadway and is so disabled as to constitute an obstruction to traff ic and the person or persons in charge of the vehicle are by reason of physical injury incapacitated to such an extent as to be unable to provide for its custody or removal. ------_._-.._-_.~-_._~_._-_._---_._--._-_...._--.--_._-- B.When any vehicle is left unattended upon a street and is so illegally parked as to constitute a definite hazard or obstruction to the normal movement of traffic. c.When any vehicle is left parked upon a street for a continuous period of twenty- four (24)hours or more.A diligent effort shall first be made to locate the owner.If the owner is found he shall be given an op- portunity to remove the vehicle. D.When any vehicle is left parked in violation of a ban on parking during a snow emergency as proclaimed by the mayor. In add ition to the penal ties hereinafter provided, the owner or driver of any vehicle impounded for violation of any of the provisions of this ordinance shall be re- quired to pay the reasonable cost of towing charges and storage. Stopping,Standing or Parking §502.l5.Parking Signs Required.Whenever by this or any other ordinance of this city any parking time limi t is imposed or parking is prohibited on designated streets or portions of streets it shall be the duty of the police department to erect appropriate signs giving notice thereof and no such regulations shall be effective unless signs are erected and in place at the time of any alleged offense.When signs are so erected giving notice thereof, no person shall disobey the restrictions stated on such signs. §502 .16.Prohibi ted parking During Snow Emergency. No person shall park,abandon or leave unattended any vehicle on any publ ic street,alley or city-owned off- street parking area during any snow emergency proclaimed by the mayor unless the snow has been removed or plowed from said street,alley or parking area and the snow has ceased to fall.A snow emergency parking ban shall con- tinue from its proclamation through the duration of the snow or ice storm and the forty-eight (48)hour period after cessation of such storm except as above provided upon streets which have been fully opened. ~ ~, I'-II II J , i ), / .~--- Such a ban shall be of uniform appl ication and the police department is directed to widely publicize the requirements,using all available news media,in early November each year.When predictions or occurrences indicate the need,the mayor shall proclaim a snow emer- gency and the pol ice department shall inform the news media to publicize the proclamation and the parking rules thereunder.Such emergency may be extended or shortened when conditions warrant. A sign stating these restrictions shall be posted in each block of street within the affected area.This section shall not be construed as suspending parking limitations or restrictions imposed by any other section of this ordinance. §502.17.All-Night parking Prohibited.No person,except physicians or other persons on emergency calls,shall park a vehicle on any street marked to prohibit all night parking and giving notice thereof,for a period of time longer than thirty (30)minutes between the hours of 2 A.M.and 5 A.M.of any day. Penalties and Procedure on Arrest §502.18.Arrest a peace off icer has person has violated officer may: and Notice to Appear.Whenever reasonable cause to believe that a any provision of this ordinance such A.Immediately arrest such person and take him before a magistrate having jurisdiction,or B.Without arresting the person,prepare in five copies a written summons to appear in court containing the name and address of such person,the operator or chauffeur li- cense number,if any,the reg istration num- ber of his vehicle,the offense charged,the time when and place where such person shall appear,and if the offense charged by speed- ing such summons shall also specify the speed at which such person is alleged to have driven and the speed limit applicable within the district or location • The original and copy of the summons shall be delivered to the Court where the defen- dant is to appear 1 2 copies to be given to the defendant 1 and one copy to the law en- forcement agency of the officer. ,1 §502.l9.penalty_Anyone violating any of the provisions of this ordinance shall,upon conviction,be subject to imprisonment not exceeding thirty (30)days,or a fine not exceeding $100.00. Section 2.Effective date _This ordinance shall be in effect after its final passage,approval,and publication as required by law.
