ORDINANCE No.2012
AN ORDINANCE PROVIDING FOR REGULATING AND LICENSING OF
COMMERCIAL HAULERS OF REFUSE AND PROVIDING PENALTIES FOR
VIOLATIONS.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Definition of Terms.
A.Refuse.Garbage,rubbish and all other
putrescible and non-putrescible wastes,

Section 2.License Required.Any commercial
hauler engaging in hauling refuse within the city limits
of Waukee,Iowa,without first obtaining a license as
herein provided shall be in violation of this ordinance.
Section 3.Application for License.An appli-
cation in writing shall be filed with the City Clerk for a
license under this ordinance.Such application shall set
forth the appl ican t's name,permanen t and local address,
business address,if any,a description and license number
of the vehicle to be used for hauling,and a statement
that the commercial hauler will not haul refuse to the
Dallas County Land Fill other than refuse collected in
Dallas County and shall be accompanied by a certification
from an insurance company authorized to write liability
insurance in the State of Iowa that such applicant has
liability insurance in a minimum amount of $100,000.00 per
person,$300,000.00 per accident,and $25,000.00 property
damage on the vehicle to be used for hauling.
Section 4.Issuance of License.If the City
Clerk finds that the application is made out in compliance
with this ordinance,and the facts stated in said
application are correct,the Clerk shall issue a license
which shall be valid for the period of time for which the
liability insurance is in force.
Section 5.Penalty.Anyone violating any of the
provisions of this ordinance shall,upon conviction,be
subject to imprisonment not exceeding thirty (30)days,
or a fine not exceeding $100.00.Each day that a
violation continues to exist shall constitute a separate
offense.
