ORDINANCE NO.
An ordim.nce prohibiting certain motor vehicle traffic over and across
pub.Ld.cland owned by the T"vm of \V:A.U1r",~,Iowa,exc Lus Lve of stt'"""ts&highways.
Be it enacted by the Council of the To.m of Wanke",Iowa:
SECTION 1.Definition.For use within this ordinance the following are
defined:
"Street or highway"means the entire width between the property lines of
every way or place of whatever nature when any part thereof is open to the use
of the public,as a matter of right,for purposes of vehicular traffic.
''1'lotorvehicle"meins every vehicle which is self-propelle,d but not in-
cluding vehicles known as trackless trolleys which are propelled by electric
power obtained from overhead trolley wires,but not opera ted upon rails.
"Public lands"means that property which is not an established street or
highway which is owned by the town of Wankee,Iowa,or which lies .dthin the
corporate limits of the To,m of W~ukee and is owned by any other governmental
SUbdivision or school district.
"Administrative officer"means the officer designated by the council of the
Town of Waukee,Iowa,to administer the affairs of the tovrn and shall be synony-
mous with th"words "Tovm clerk.II
SECTION 2.Motor vehicle traffic prohibited.No person shall operate a
motor vehicle upon pUblic l~nds unless such operation has been specifically
authorized by the ad~inistrative officer of the Tovm of Waukee,Iowa.
SECTION 3.Penalty.Anyone violatinp,any of the provisions of this
ordinance shall,upon conviction,be subject to imprillsonment not exceeding
30 days,or a fine not exceeding $100.00 or by both fine and imprisonment.
SECTION 4.Repealer.All ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby rep~aled.
SECTION 5.Saving clause.If any section,provision,or pert of this
ordinance shall be adjudged to be invalid or 1.ll1constitutional,such E>djudi-
cation shall not affect the validity of this ordin~nce as a whole or any
sectinn,provision,or part th"re,f not adjudged invalid or unconstitutional.
SECTION 6.When Effective.This ordinance shall be in effect after it's
final passage,approval ~nd pUblication as provided by 1~~.
Passed by the Council on the 14th day of July,1969,and approved this
14th day of July,1969.
