AN ORDINANCE TO AMEND SECTION 224D.3 TO ADJUST TI-IE AREA INCLUDED IN
THE WAUKEE CONNECTION FF_,E DISTRICT DUE TO CITY LIMIT ADJUSTMENTS
ALONG INTERSTATE 80
WHEREAS, Section 384.38 of the Code of Iowa authorizes cities to establish by
ordinance connection fee districts and corresponding schedules of fees in order to allocate the
cost of improvements necessary to extend sewer service to properties within such a district; and
WHEREAS, pursuant to Section 384.38, the City of Waukee (the "City") established the
Waukee Connection Fee District (the "District") in 2005 and established a corresponding
schedule of connection fees, in accordance with Iowa law; AND
WHEREAS, the abandonment of the rest area along the North side of Interstate 80 and
the annexation of the property remnants that resulted have necessitated an adjustment to the area
included in the connection fee district to include that area and allow a mechanism for providing
sewer to that area as it develops.
BE IT THEREFORE ORDAINED by the Council of the City of Waukee:
Section 1. That Chapter 224D.3 of the Waukee Municipal Code is hereby amended by
repealing 224D.3 and enacting in lieu thereof:
Section 224D.3
The Waukee Connection Fee District is hereby established and shall include the following
real property situated in the City of Waukee, Dallas County, Iowa:

Section 2. The Chapter 224D.6(b) of the Waukee Municipal Code is hereby amended by
repealing 224D.6(b) and enacting in lieu thereof:
224D.6(b)
b) The Fees are based upon the equitable costs of extending sanitary sewer service to the
benefited area. From the effective date of this ordinance, unless otherwise amended fees
shall be imposed on a per acre basis in the amount of $5,010.00 per acre. Said
Connection fee shall increase annually commencing on January 1, 2020, and annually
thereafter, at a percentage equal to the Consumer Price Index published for the most
recent year, and would be rounded down to an even $10.
Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 4. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 5. Effective Date. This ordinance shall be in effect from and after its final
passage, approval and publication as provided by law.
