RESOLUTION 19-414
APPROVING THE SETTLEMENT AGREEMENT BETWEEN LEACH FAMILY
FARMS, INC., AND THE CITY OF WAUKEE [NORTHWEST AREA TRUNK SEWER
EXTENSION PHASE 4 PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, during construction of the Northwest Area Trunk Sewer Extension Phase 4 Project,
some property owned by Leach Family Farms, Inc., and outside of the designated easement areas
was damaged; AND
WHEREAS, the parties have agreed that the City shall pay the property owner for an extended
temporary easement in the location of the damaged areas, with the expense associated with the
extended easement payed by the contractor as part of the final project change order.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that
the settlement agreement between Leach Family Farms, Inc., and the City of Waukee are hereby
approved.
