RESOLUTION AMENDING RESOLUTION OF
NECESSITY
WHEREAS,on August 6,2007,this Council held a public hearing on a proposed
a Resolution of Necessity for the Waukee,Iowa,Southfork and Walnut Ridge Sanitary
Sewer Project;and
WHEREAS,the public hearing has been held,all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
WHEREAS,after the public hearing the Council deferred action on the Resolution
of Necessity;and
WHEREAS,on September 10,2007,the Council approved the Resolution of
Necessity,adopting the preliminary assessment schedule in the Preliminary Plat and
Schedule;and
WHEREAS,on October 15,2007,the Council approved amending the Resolution
of Necessity in light of accepted Petition,Contract and Waiver Agreement from property
owners in the assessment area which altered the assessment schedule;and
WHEREAS,the Council has accepted additional Petition,Contract and Waiver
Agreements from property owners in the assessment area which alter the assessment
schedule.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF W AUlaE,IOWA AS FOLLOWS:
Section 1.That the Resolution of Necessity approved on September 10,2007 and
amended on October 15,2007 is hereby adopted as amended by the Schedule of
Amendments attached hereto as Exhibit A,and made a part hereof by reference.All
objections filed or made having been duly considered are overruled.
Section 2.That all written requests for agricultural deferment by property owners
must be filed within ten (10)days following the date of adoption of this Resolution.

The Resolution of Necessity proposed for the Waukee,Iowa,Southfork and
Walnut Ridge Sanitary Sewer Project is amended as follows:
A.By eliminating therefrom the proposed improvements with
locations following,to-wit:

B.By making changes in the preliminary plat and schedule of
assessments as follows,to-wit:
Preliminary Assessment amounts shall be amended in accordance with the
updated preliminary plat and schedule attached hereto.
C.By amending the Resolution of Necessity,as follows,to-wit:

AMENDED PRELIMINARY ASSESSMENT PLAT AND SCHEDULE
We are transmitting herewith the amended preliminary assessment plat and schedule to be
filed covering the Southfork and Walnut Ridge Sanitary Sewer Improvements project.This
amended preliminary assessment plat and schedule supersedes the amended preliminary
assessment plat and schedule dated October 1,2007.This booklet reflects the addition of
the service connection and connection fee assessments to the following property owners:
Jeri Porter,Jeffrey &Susan Schoon,Carolyn Chase,and James Whittemore.
Property ownership is in accordance with the Dallas County,Iowa,Real Estate and Tax
Inquiry Website as of July 6,2007.Council valuations are based on the assessed
valuation according to the Dallas County,Iowa,Real Estate and Tax Inquiry Website plus
the value of the assessable improvements in place.

BENEfiTTED AREA
An area in Section 36 of Township 79 North,Range 26 West ofthe 5th Principal Meridian located
in the City of Waukee,Dallas County,Iowa,more particularly described as follows:
Commencing at the southwest corner of the east half of the southwest quarter of said Section 36;
thence northerly along the west line of the east half of the southwest quarter of Section 36 to the
north right-of-way line of University Avenue,said point being the point of beginning;thence
continuing northerly along the said west line of the east half of the southwest quarter of Section 36
to the north line of the southwest quarter of Section 36;thence easterly along the north line of the
southwest quarter of Section 36 to the northeast corner of the southwest quarter of Section 36;
thence easterly along the north line of the southeast quarter of Section 36 to the northeast corner of
Section 36;thence southerly along the east line of Section 36 to a point on the north right-of-way
line of University Avenue;thence westerly along the north right-of-way line of University Avenue
to the point of beginning.
DESCRIPTION Of IMPROVEMENTS
Construction of the Southfork and Walnut Ridge Sanitary Sewer System includes all labor,
materials and equipment necessary for approximately 23,000 linear feet of 2-inch through 4-inch
sewer main directionally bored in place,102 grinder lift stations,excavation,backfill,connections
to existing sewer services,electrical connections,startup,air release manholes,clean outs,booster
pump station,electrical work,surface restoration and miscellaneous associated work.
LOCATION Of ASSESSABLE WORK
The low pressure sanitary sewer system improvements for individual lots in the Southfork and
Walnut Ridge Subdivisions are located in southeast quarter and the east half of the southwest
quarter of said Section 36.Sanitary sewer improvement within the above described area include
the installation of 2-inch through 4-inch sewer mains along existing streets,the extension of
sanitary sewer service lines to individual lots and the installation of grinder lift stations on
developed properties.
Sewage collected within the Southfork and Walnut Ridge Subdivisions is transmitted to a booster
station located west of Westwoods Drive in Country Club Woods Plat 5 of the City of Waukee.
The booster station then pumps collected sewage northerly along Southeast Westwoods Drive,
thence westerly along Southeast Olson Drive,thence southwesterly along Southeast Brick Drive
and Alice's Road to University Avenue where the system ultimately discharges into an existing
24-inch sanitary sewer.

8ASIS OF ASSESSMENT
The distribution of project costs to benefitted properties is dependent on the type of improvements
received by those properties.Benefitted properties are subject to special assessment for sanitary
sewer improvements installed within public right-of-way and sewer service improvements
associated with connecting developed lots to the low pressure sewer system.Project costs are
distributed to the benefitted properties as follows:
Sanitary Sewer Improvements within Public Right-of-way
All project cost associated with the installation of sanitary sewer improvements within public
right-of-way are assessable.Assessable costs include engineering,legal and administrative
fees.Per the City Council of the City of Waukee,the project costs allocated to benefitted
properties will equal approximately 50%of the total associated project costs and will be
distributed equally to the 110 lots identified as being serviceable by the low pressure system.
Sewer Service Connection to the Low Pressure Sewer System
All project cost associated with connecting individual lots to the new low pressure sewer
system are assessable.Assessable costs include engineering,legal and administrative fees.
Per the City Council of the City of Waukee,the project costs allocated to benefitted properties
will equal approximately 27%of the total associated project costs and will be distributed
equally to the 102 lots identified as being developed and serviceable by the low pressure
system.
Connection of the Low Pressure Sewer System to Existing City Sewer System
Connection of the low pressure sanitary sewer system to the existing city sewer system
results in the reduction of the overall available capacity of the University Avenue Trunk
Sewer and additional loading at the existing wastewater treatment plant.The additional
sewage collected from the low pressure sewer system promotes development of the future
WRA Improvements.
Costs associated with connecting the new low pressure sewer system to the existing sewer
system are assessable.Assessable costs include the "University Avenue connection fee"and
the "Wastewater Treatment Improvements connection fee".The total connection fee will be
distributed equally to the 118 lots within the Southfork and Walnut Ridge Subdivisions.
The total connection fee for individual lots for the connection of the low pressure sewer system
to the existing city sewer system is calculated as follows:

The Southfork and Walnut Ridge Sanitary Sewer System is 100%assessable.Properties receiving
benefit from the project will be assessed 50%of the total project costs for the installation of sewer
improvements within public right-of-way and approximately 27%of the total project costs associated
with connecting individual sewer services to the new low pressure sewer system,plus a 10%default
fund.All properties who connect to the new low pressure sewer system will also be assessed 100%of
the costs associated with connecting the new low pressure sewer system to the existing city sewer
system,plus a 10%default fund.The total assessments for the benefitted properties are calculated as
follows:
