WAUKEE CITY COUNCIL MINUTES
November 16, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair
(electronically). Absent: Council Member Anna Bergman. (Council Member Bergman began
participating electronically at 5:38 p.m.)
Also in attendance: City Administrator Tim Moerman, Development Services Director Brad
Deets (electronically), Finance Director Linda Burkhart (electronically), Public Works
Director/City Engineer Rudy Koester (electronically), Parks & Recreation Director Matt Jermier
(electronically), Marketing & Communications Director Summer Evans (electronically), IT
Director Son Le (electronically), Human Resources Director Michelle Lindsay (electronically),
Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick
(electronically).
(D) Open Forum — 1) John Dvorak, 645 Silverleaf Ln., addressed the council regarding Agenda
Item #113 (discussion of Silverleaf Ln. alignment). He stated that it appeared that the
Development Services Department was promoting one alignment option over any others. He
then listed what he saw as the positives and negatives of each of the three presented options,
adding that he favored a lack of neighborhood connectivity from Willow Pines. Mayor Clarke
said that she disagreed that City staff were only promoting one option, adding that one of the
council's goals is strong neighborhood design and that the alignment is ultimately the council's
decision. 2) Mike Lang, 3100 Caterine Ct., spoke on the same matter as Mr. Dvorak, noting
existing access points to Willow Pines (Silverleaf Ln. and Jackpine Dr.) and stating that it was
unlikely that both access points would be simultaneously closed to traffic. (Council Member
Bergman began participating electronically at 5:38 p.m.)
(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 — 0.
(F) Presentations: None
(G) Public Hearings:
1) On a proposed North Waukee Residential Urban Renewal Plan in the City of Waukee —
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
reviewed the plan area, which includes two market -rate multi -family developments currently
under construction. The majority of the units within those developments are one -bedroom or
smaller. Residential urban renewal areas are 10-year plans, whereas commercial areas are
20-year plans. Aproximately one-third of the TIF revenue generated by the North Waukee
Residential Urban Renewal Plan will be set aside for low to moderate income (LMI) funding
opportunities. The remaining two-thirds of revenue can be used for public improvement
projects, with two Douglas Pkwy. extension projects identified for the use of those funds. A
consultation hearing was held on October 26 with no one attending; the Planning & Zoning
Commission also reviewed the plan and recommend approval. No comments were made by
the public in attendance.
(H) Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution determining an area of the City
to be an economic development area, and that the rehabilitation, conservation,
redevelopment, development or a combination thereof, of such area is necessary in
the interest of the public health, safety or welfare of the residents of the City;
designating such area as appropriate for urban renewal projects; and adopting the
North Waukee Residential Urban Renewal Plan — Council Member Lyon moved to
approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes:
Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 — 0. (Resolution
#2020-429)

1) Consent Agenda: Council Member Lyon moved to approve the Consent Agenda; seconded
by Council Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon,
Sinclair. Nays: None. Motion carried 5 — 0.

Municipal Code, by repealing the current chapter and in lieu thereof adopting by
reference the 2018 edition of the International Codes, with amendments,
modifications, additions and deletions as specified [introduction; first reading] -
Council Member Crone introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Sinclair. Development Services Director Deets
stated that the proposed ordinance would adopt the 2018 I-CODESTM, with amendments.

3) Ordinance: Consideration of approval of an ordinance to amend Chapter 222A,
Waukee Municipal Code, by repealing the current chapter and enacting in lieu therof
Chapter 222A, Residential Rental Code [introduction; first reading] - Council Member
Lyon introduced the ordinance and moved to approve the first reading in title only; seconded
by Council Member Crone. Development Services Director Deets stated that the only
revisions to the ordinance were updated references to the 2018 I-CODESTM. Results of

includes single family residential development and two outlots planned for future townhome
development. The parkland dedication area is planned as part of the greenbelt corridor, with
connections to the larger recreational trail network. Results of vote: Ayes: Bergman,
Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 — 0. (Resolution #2020-

7) Resolution: Consideration of approval of a resolution approving preliminary plat for
Autumn Valley— Council Member Crone moved to approve the resolution; seconded by
Council Member Lyon. Development Services Director Deets noted that the plat was for
single family residential development and that the townhome development to the south
would be platted at a later date. He noted the 10th St. alignment, which was discussed at
earlier council meetings, as well as other street extensions and a parkland dedication area
that would be part of the greenbelt corridor system and connect to a larger park to the north.
A stormwater detention pond will be maintained by a homeowner's association. Council
Member Bottenberg asked if there were any objections from neighbors regarding the
alignment of 10th St.; Mr. Deets replied that he and Mayor Clarke hosted a neighborhood
meeting following the rezoning approval and that the current street alignment was that which
was presented at that meeting. While the townhomes are not being platted at this time, the
developer agreed to certain concessions related to that part of the project, including building
design and configuration, green space and buffering. Mayor Clarke added that during the
neighborhood meeting, the townhome design concessions appeared to put many other
concerns to rest. She added that she received correspondence after that meeting from
neighbors who could not attend, and that those neighbors were comfortable with what was
proposed. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.

9) Resolution: Consideration of approval of a resolution approving preliminary plat for
Waukee Market Place Plat 3 — Council Member Crone moved to approve the resolution;
seconded by Council Member Lyon. Development Services Director Deets briefly reviewed
the preliminary and final plats, as well as the Dupaco Credit Union site plan. The preliminary
plat addresses a reconfiguration of property lines. He also reviewed parking, site
ingress/egress and exterior building elevations. Council Member Sinclair asked if the
building was proposed for use by a single tenant; Mr. Deets replied that it was presented as
a one -tenant building but that it could have leasable space. Mayor Clarke noted that the
project highlights the importance of traffic management in the area; Mr. Deets responded
that City staff supports the proposed use as appropriate for the site. Results of vote: Ayes:

noting that the developer had bonded for some minor punch list items. Results of vote:

13) Discussion: Silverleaf Lane alignment — Development Services Director Deets again
presented three alignment options, reviewing some of the previous council discussions on
the matter. He also discussed possible traffic calming measures for Option 1 (Silverleaf Ln.
extended from its current terminus to Ashworth Rd.), such as the removal of a right -turn
deceleration lane off Ashworth Rd. to Silverleaf Ln. and a diversion island at the dividing line
between Willow Pines and Hamilton Ridge. After a brief discussion, a majority of the council
favored Option 3 (a new cul-de-sac off Ashworth Rd. with no connection to Willow Pines).
(J) Reports — Report made by Council Member Lyon.
(K) Closed Session: Pursuant to Code of Iowa §21.5(1)(c) to discuss strategy with counsel in
matters that are presently in litigation or where litigation is imminent where its disclosure
would be likely to prejudice or disadvantage the position of the governmental body in
that litigation — Council Member Crone moved to close the regular session and enter closed
session pursuant to Code of Iowa §21.5(1)(c); seconded by Council Member Sinclair. Results of
