RESOLUTION 09-105
RESOLUTION AUTHORIZING THE TERMINATION OF THE LEASE BY THE CITY
TO A TENANT OF THE PROPERTY LOCALLY KNOWN AS 25 NORTHVIEW
DRIVE,WAUKEE,IOWA
IN THE NAME AND BY THE AUTHORiTY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City entered into a residential lease agreement (hereinafter referred to as the
"Agreement")for certain property locally known as 25 Northview Drive,Waukee,Iowa under
which the tenant was to pay unto the City Rent,provide utilities and provide care and
maintenance for a period of one year;AND
WHEREAS,the tenant has been delinquent in some of his responsibilities under said lease and
has informed the City Administrator that he would like to terminate the lease prior to the
expiration of its one-year term;AND
WHEREAS,it is the best interest of the City that the lease on the property be terminated early
provided adequate arrangements are made for the satisfaction of any amounts and or obligations
of tenant accruing under the lease.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee that
Residential Lease for 25 Northview Drive may be terminated in writing by the City
Administrator without further action of the Council provided arrangements are made for the
recovery of any amounts or obligations of Tenant remaining due to the City as of the date of any
such termination.
