RESOLUTION 09-53
AUTHORIZING AFPROV AL AND ACCEPTANCE OF PURCHASE
AGREEMENT AND DEED FOR THE 105TH STREET/ALICE'S ROAD
OVERPASS OF 1-80 PROJECT,mOT NO.HDP-8177(6Q6)--71-25
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,previously the City Council of the City of Waukee,Iowa approved the
lOS'h Street/Alice's Road Overpass ofI-80 Project;and
WHEREAS,the City Council heretofore ordered preparation of plans,specifications,
form of contract and estimate of cost for the public improvement project known the 10S'h Street/
Alice's Road Overpass ofI-80 Project,mOT NO.HDP-8177(606)--71-2S;and
WHEREAS,the City Council has previously established the fair market value and
authorized the acquisition of property and easements necessary for the construction of the lOSth
Street/Alice's Road Overpass ofI-80 Project;and
WHEREAS,the City of West Des Moines has negotiated a purchase agreement for the
acquisition of property and easement necessary for the Project;and
WHEREAS,the name of the property owner and the just compensation of the property
to be acquired is attached hereto as Exhibit "A"and made a part of this resolution;and
WHEREAS,approval of the purchase agreement which is on file with the Waukee City
Clerk is in the best interest of the City of Waukee.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WAUKEE,IOWA,THAT:
1.The Purchase Agreement and Easement document and the deed for the acquisition
of property necessary for the lOSth Street!Alice's Road Overpass ofI-80 Project
is hereby approved.
2.The Mayor is authorized to sign and the City Clerk is directed to attest to the
Mayor's signature on the Purchase and Easement Documents and deed and
execute all other necessary documents for the acquisition of property for the
Project.
3.The City Legal Department is authorized to take all steps necessary consistent
with the Purchase and Settlement Agreement to acquire the property.
4.The Director of Finance is authorized to make payment to the property owners
shown on the attached Exhibit "A"pursuant to the terms and conditions ofthe
Purchase Agreement and Temporary Easement Agreement.
