RESOLUTION 09-52
RESOLUTION AUTHORIZING APPROY AL OF CONDEMNATION AWARDS
REGARDING THE 105TH STREET/ALICE'S ROAD OVERPASS OF 1-80 PROJECT,
mOT NO.HDP-8177(606)--71-25
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,lOW A
WHEREAS,previously the City Council of the City of Waukee,Iowa approved theins"Street/Alice's Road Overpass ofl-80 Project;and
WHEREAS,the City Council heretofore ordered preparation of plans,specifications,
form of contract and estimate of cost for the public improvement project known the 10S'h Street/
Alice's Road Overpass ofl-80 Project,mOT NO.HDP-8177(606)--71-2S;and
WHEREAS,the City Council has previously established the fair market value and
authorized the acquisition of property and easements necessary for the construction of the 105"'
Street!Alice's Road Overpass ofl-80 Project;and
WHEREAS,the City of West Des Moines has condemned property necessary for the
-cons ITncliuH of theimpro v emenls forthe Projectrand
WHEREAS,the property owners and the condemnation awards are shown on the
attached Exhibit "A"and made a part of this resolution;and
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WAUKEE,IOWA,THAT:
1.The condemnation awards made for the acquisition of property necessary for the
Alice's Road/10Sth Street Overpass ofl-80 Project are hereby approved.
2.The Mayor is authorized to sign and the City Clerk is directed to attest to the
Mayor's signature on all documents necessary for the acquisition of property for
the Project.
3.The City Legal Department is authorized to take an steps necessary consistent
with the awards to acquire the property.
4.The Director of Finance is authorized to pay the awards as shown on the attached
Exhibit "A,n
