RESOLUTION 09-54
AUTHORIZING APPROVAL AND ACCEPTANCE OF TENANT
PURCHASE/RELOCATION AGREEMENT FOR THE 105TH STREET/ALICE'S
ROAD OVERPASS OF 1-80 PROJECT,mOT NO.HDP-8177(606)--71-25
WHEREAS,previously the City Council of the City of Waukee,Iowa approved theios'"Street/Alice's Road Overpass ofI-80 Project;and
WHEREAS,the City Council heretofore ordered preparation of plans,specifications,
form of contract and estimate of cost for the public improvement project known the 10Sth Street!
Alice's Road Overpass ofI-80 Project,mOT NO.HDP-8177(606)--71-2S,(f/k/a STP-U-8260
(617)--70-77),WDMNO.OSI0-0IS-2008;and
WHEREAS,the City Council has previously established the fair market value and
authorized the acquisition of property and easements,including any leasehold interests and/or
relocation assistance,necessary for the construction of the lOSlh Street!Alice's Road Overpass
ofI-80 Project;and
WHEREAS,the City of West Des Moines has negotiated a purchase/relocation
agreement with one of the tenants on property owned by Oakleaf Properties for acquisition of
property necessary for the Project;and
WHEREAS,the name of the tenant and the just compensation of the leasehold interest
and relocation assistance to be acquired is attached hereto as Exhibit "A"and made a part of this
resolution;and
WHEREAS,approval of the tenant purchase/relocation agreement which is on file with
the Waukee City Clerk is in the best interest of the City of Waukee.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WAUKEE,lOW A,THAT:
1.The Tenant PurchaselRelocation Agreement necessary for the acquisition of
property for the IOS111 Street!Alice's Road Overpass ofI-80 Project is hereby
approved.
2.The Mayor is authorized to sign and the City Clerk is directed to attest to the
Mayor's signature on the Tenant Purchase/Relocation Agreement and execute all
other necessary documents for the acquisition of property for the Project.
3.The City Legal Department is authorized to take all steps necessary consistent
with the Tenant PurchaselRelocation Agreement to acquire the property.
4.The Director of Finance is authorized to make payment to the tenant shown on the
attached Exhibit nAn pursuant to the terms and conditions of the Tenant
Purchase/Relocation Agreement.
