RESOLUTION 07-26
APPROVING THE AM/<;NDJW WATER SERVICE AGREEMENT BETWEEN
MIDWEST COUNTRY ESTATES AND THE CITY OF WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the owner of Midwest Country Estates approached the City of Waukee with some
IDNR issues affecting their site;AND,
WHEREAS,on December 18,2006,the City Council approved the Water Service Agreement
with Midwest Country Estates (Resolution #06-251);AND,
WHEREAS,after City Council approval of the agreement,the attorney for Midwest Country
Estates requested language changes in the agreement,specifically as to when the CPI would
commence and changing dates from calendar year to fiscal year;AND,
WHEREAS,the City Attomey and City staff have reviewed the proposed language changes and
find said changes to be agreeable;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
22nd day of January 2007 that it hereby approves the amended Water Service Agreement with
Midwest Country Estates,
