RESOLUTION 07-51
APPROVING A SUPPLEMENTAL AGREEMENT WITH ECO-TECH
CONSTRUCTION FOR REMAINDER OF WORK TO BE COMPLETED FOR PCC
PAVEMENT RECONSTRUCTION PROJECT #STP-U-8177(605)-70-25 ON
UNIVERSITY AVENUE,WACO PLACE TO WEST OF ALICE'S ROAD
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the Contractor and Owner have previously entered into an agreement on for work
covered by the terms of the plans and specifications and proposal;AND,
WHEREAS,the Contractor has completed all work on the project with the exception of seeding,
sodding,metal railing,pavement markings,erosion control 98th Street,fence removal Swartz
property,and miscellaneous final punch list items.The work remaining on the project carmot be
completed until later in the spring of2007 as a result of weather conditions;AND,
WHEREAS,the work to date encompasses more than 96%of the value of the project and the
remaining work cannot be completed for a period of more than 60 days.Said delay in
completion of the work is the result of winter weather conditions and not directly the result ofthe
Contractor's activities;AND
WHEREAS,the said plans,specifications and proposal blanks accurately and fully describe the
terms and conditions upon which the Contractor has performed the work specified and the
Contractor is willing to perform the remaining work under this Supplemental Contract;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the City of
Waukee hereby approves a supplemental agreement with Eco-Tech Construction for remainder
of work to be completed for PCC Pavement Reconstruction on University Avenue,Waco Place
to west of Alice's Road.
Passed by the City Council ofthe City of Waukee,Iowa,and approved the 12th day of March
2007.
