RESOLUTION 06-243 ,
APPROVING THE PERPETUAL OVERLAND STORM WATER FLOWAGE
EASEMENT CONVEYED FROM THE CITY OWNED PROPERTY LOCATED AT
14705 SE UNIVERSITY TO THE CITY OF W AUKEE,IOWA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State oflowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City of Waukee will obtain the perpetual overland stormwater flowage
easement prior to the sale of the lot;AND,
WHEREAS,City staff agrees to secure for the consideration of the sum of One Dollar ($1.00)a
Perpetual Overland Stormwater Flowage Easement,over,under,through and across the south
180 feet of the west 220 feet of the Southeast Quarter of the Southwest Quarter (SE Y.SW Y.)of
Section 36,Township 79 North,Range 26 West of the 5'h P.M.,Dallas County,Iowa;AND,
WHEREAS,the easement has been reviewed by city staff,Veenstra &Kimm,Inc.and the City
Attorney and no discrepancies were noted.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
11th Day of December 2006 that it hereby approves the Perpetual Overland Stormwater Flowage
Easement from the City owned land located at 14705 SE University Avenue to the City of
Waukee,Iowa.
