RESOLUTION 08-11
APPROVING THE USE OF PRIVATE CONTRACTORS FOR SIDEWALK
SNOW REMOVAL
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,Waukee Municipal Code Section 218.2(E)provides that if snow and ice
accumulations on sidewalks are not removed by the abutting property owner within a
specific period of time following the cessation of a storm or other cause of accumulation,
the City Administrator may,after affording reasonable notice to the abutting property
owner,cause the accumulations to be removed by the City and the costs assessed and/or
otherwise collected from the property owner;AND,
WHEREAS,in enforcing compliance with the Waukee Municipal Code,as it pertains to
sidewalk snow and ice removal by property owners,the City expends a significant
amount of time and resources in order to remove accumulations and the use of private
contractors will be more cost efficient in abating the nuisance created by property owners
non-compliance with existing law;AND,I
WHEREAS,City staff reconunends the use of private contractors for snow removal
from non-compliant properties,when so determined by the City Administrator,with the
following rates charged to property owners per property:
•$45.00 per hour,with a one-hour minimum charge;plus
•$45.00 administrative fee;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 7'h day of January,200S,that it hereby approves the use of private contractors
for sidewalk snow removal on non-compliant properties,as determined by the City
Administrator's in accordance with existing ordinances,at the above referenced rate
schedule and the collection of said costs in the form of assessments or otherwise against
non-compliant properties and/or property owners.~Ni;---
