RESOLUTION 07-220
APPROVAL OF A POLICY RELATED TO PERMITTING AND FENCING OF
PRIVATE RESIDENTIAL SWIMMING POOLS
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the Waukee City Council has requested a policy to set forth and clarify City
regulations related to the permitting and fencing of private residential swimming pools,a copy of
which is attached hereto and made part of this resolution;AND,
WHEREAS,City staffrecomrnends approval of the policy;AND,
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
15th day of October,2007,that it hereby approves the policy related to permitting and fencing of
private residential swimming pools.

Regulations and
City Policy for PermitsTheKeytoGoodLiving

Purpose:It is the intent of this Policy and the Ordinances pertaining to regulations of
private residential swiunning pools previously established within the Waukee Municipal
Code to protect the health,safety and well being ofthe residents of the City of Waukee
with respect to proper construction,construction techniques and premises safety for
residential swimming pools and to define the provisions and requirements for the
acquisition of a builcling permit for both permanent and temporary residential swimming
pools.
Definitions:
Swimming Pool-A water filled structure,permanently constructed or portable,including
both structures constructed below and above grade,which has the ability for a depth of 18
inches or more intended for swimming or recreational bathing but excluding the
following:
I)Stormwater retention and/or detention basins on property owned by the
city,county,state or federal government.
2)Stormwater retention and/or detention basins constructed and maintained
in substantial compliance with an approved site plan,preliminary plat,
construction drawings or other city approved design.
Wading Pool-A water filled structure which is portable,has a depth of 18 inches or less
at any point and is primarily intended for use by young children for general recreation
purposes.
Examples of Types of Pools:Please note that the examples presented below are not
inclusive of all types of pools that would be considered as either swimming pools or
wading pools.

Requirements:
I)Swimming pools as defined and shown above are required to have a minimum
four foot (48")tall non-climbable barrier or fence which meets all of the
requirements ofthe International Building Code as adopted by the City of
Waukee and amended from time to time.
2)Wading pools as defmed above are exempt from non-climbable barrier or fence
requirements.
Permits:
A building permit shall be required for all swimming pools as defined above.A separate
permit is required for the non-climbable barrier or fence.
In the case of a permanent swimming pool which can be defined as an in-ground
swimming pool or above ground swimming pool that is not taken down and stored on an
annual basis,the permit cost shall be calculated on a valuation basis similar to a building
permit for a house.
In the case of a temporary swimming pool which can be defined as an above-ground
swimming pool that can be easily moved and is typically taken down on an annual basis,
the permit cost shall be a flat rate of $20.00.
Wading pools as defined above do not require a permit.
