RESOLUTION 07-219
APPROVING THE FINAL PLAT FOR
WESTGATE BUSINESS PARK PLAT 3
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,DJN,LLC (the "Developer")has requested final approval of Westgate Business
Park Plat 3 (the "Plat")which is a replat of Lot I of Westgate Business Park Plat 2;AND
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Plat for on
July 31,2007;AND,
WHEREAS,the Developer has filed with the City of Waukee a Second Amendment to
Amended and Substituted Declaration of Easements,Covenants,Conditions and Restrictions for
Westgate Business Park Plat 2 to be recorded with the Plat therefore;AND
WHEREAS,the Final Plat for Westgate Business Park Plat 3 and the documents relating thereto
comply in all respects with Section §303 -Land Subdivision Ordinance of the Waukee
Municipal Code;
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 15th day of October 2007 that the Final Plat for Westgate Business Park Plat 3 be and the
same is hereby accepted and approved by the City Council of the City of Waukee subj ect to final
review and approval of the legal documents by the City Attorney.
BE IT FURTHER RESOLVED that the City ofWaulcee does hereby accept the following
additional easements to be filed with the Plat subject to final review and approval by the City
Attorney:
1.Easement for Private Ingress/Egress;
2.Easement for Private Water Main;and
3.Easement for Private Sanitary Sewer
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the Second
Amendment to Amended and Substituted Declaration of Easements,Covenants,Conditions and
Restrictions (collectively,the "Covenants")for the Plat subject to final review and approval by
the City Attorney and the City Clerk is directed to file such Covenants with the Plat.
BE IT FURTHER RESOLVED that the sidewalks within the Plat are not now constructed,
provided,however,that in no event shall a certificate of occupancy be issued on a lot within the
Plat until all sidewalks on such lot that are required by the Plat are constructed,
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
final plat of Westgate Business Park Plat 3,as well as any other documents related thereto,with
the Dallas County Recorder.
