RESOLUTION 07-224
RESOLUTION AUTHORIZING THE CLOSING OF PROPERTY PURCHASED BY
THE CITY LOCATED IN THE URBAN RENEWAL AREA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City previously approved an Offer to Buy Real Estate and Acceptance
Agreement (hereinafter referred to as the "Agreement")which was accepted b(,'the Seller,James
D.Clayton,on May 24,2007 for certain property generally located West of6t1 street in Waukee,
Iowa and generally described as:
That portion of the Southwest Quarter of Section 33 lying west of the 6th Street in Waukee,all in
Township 79 North,Range 26 West of the 5th P.M.,Dallas County,Iowa consisting of
approximately 100.94 Acres.
WHEREAS,the City Council of the City of Waukee has deemed it to be in the best interest of
the City to purchase the property described above and that said property is now included in the
City's Urban Renewal Area;AND
WHEREAS,the conditions of the offer have been satisfied by the City desires to proceed with
the closing and purchase of said property in accordance with the terms of the agreement between
the parties.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee on this,
the nnd day of October 2007,that the purchase of the property proceed in accordance with the
purchase agreement between the parties.
BE IT FURTHER RESOLVED that the balance of the purchase price in the amount of
2,821,500.00 should be remitted to the Brick Gentry Law Firm Trust Account in anticipation of
closing on the property.
BE IT FURTHER RESOLVED that the City Attorney is authorized to proceed with closing the
property upon the receipt of a warranty deed executed by the owner(s)of said property
conveying the property to the City in accordance with the purchase agreement between the
parties,Upon receipt of said deed by the City,the earnest money previously deposited in the
Blick Gentry Law Firm Trust Account,together with the balance of the purchase price remitted
to the Brick Gentry Trust Closing Account,shall be paid to Seller(s).
