Home My WebLink About2007-11-05-Resolutions 07-241_DSM Regional Transit - Amended AgreementRESOLUTION 07-241 APPROVAL OF AMENDED AND RESTATED AGREEMENT FOR THE DES MOINES REGIONAL TRANSIT AUTHORITY WHEREAS,the Cities of Des Moines,West Des Moines,Windsor Heights,Urbandale, Clive,Ankeny,Altoona,Mitchellville,Bondurant,Runnels,Pleasant Hill,Carlisle,Elkhart, Alleman,Sheldahl,Polk City,Granger,Grimes,Johnston,and Polk County,Iowa are now parties to an Intergovernmental Agreement Creating the Des Moines Regional Transit Authority, initially signed by the original parties and filed of record in the Office of the Iowa Secretary of State,on June 19,2006;and WHEREAS,the legislation enacted by the Iowa Legislature,now constituting Chapter 28M of the Iowa Code,enabled and authorized the reorganization of the Des Moines Metropolitan Authority in the form of a regional transit authority,with expanded powers and authorization for organizations formed pursuant to Chapter 28M of the Iowa Code;and WHEREAS,the amended and restated said Agreement provides for the organization and governance of the Des Moines Regional Transit Authority pursuant to the provisions of,and with all powers provided in,Chapter 28M of the Iowa Code;and WHEREAS,the parties to said Intergovernmental Agreement have extended the offer to the City of Waukee,Iowa to participate in the Des Moines Regional Transit Authority by approving the Amended and Restated Agreement for the Des Moines Regional Transit Authority to include the City of Waukee; NOW,THEREFORE,IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF WAUKEE,row A: 1.That the Amended and Restated Agreement for the Des Moines Regional Transit Authority, is hereby approved as to form and content.A copy of this Agreement is on file with the City Clerk of the City of Waukee. 2.That the Mayor is authorized to execute the Amended and Restated Agreement for the Des Moines Regional Transit Authority,and the City Clerk is authorized to attest his signature.
