RESOLUTION 07-253
RESOLUTION AUTHORIZING THE EXECUTION OF A RELEASE OF LIEN
CONCERNING THE LIEN CREATED BY VIRTUE OF A DEVELOPMENT
AGREEMENT EXECUTED BETWEEN THE CITY OF WAUKEE AND HUBBELL
REALTY COMPANY FOR THE DEVELOPMENT KNOWN AS GLYNN VILLAGE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City entered into a Development Agreement with Hubbell Realty Company
conceming property which was the subject of development,the development known as Glynn
Village;and
WHEREAS,pursuant to the terms of the Development Agreement,certain payments were
contemplated pertaining to sanitary sewer;and
WHEREAS,the payments contemplated under the agreement were paid;and
WHEREAS,it is not the intent of the City to release Hubbell Realty Company from the
obligations contained in the Development Agreement but instead to release the lien and
encumbrance created by virtue of the Development Agreement's recordation with the Dallas ]
County Recorder,and such release is attached hereto and incorporated herein by this reference;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the release of lien attached hereto and incorporated herein is hereby approved and the Mayor
is authorized to execute the same on behalf of the City.

COMES NOW the City of Waukee,Iowa and pursuant to Resolution No.07-253 passed
by the City Council on the 19th day of November,2007 releases the lien created by virtue of the
Development Agreement dated August 2,2004 between the City of Waukee,Iowa and Hubbell
Realty Company,an Iowa corporation,recorded at Book 2004,Page 15861 on October 8,2004
in the Dallas County,Iowa,Recorder's Office.This release pertains to the property legally
,described on Exhibit A attached hereto and incorporated herein by this reference.
This release does not release Hubbell Realty Company from any and all obligations that
may exist in the Development Agreement but does release any lien or encumbrance created on
,the property described above.

On this l.lil day of November,2007before'me,the undersigned,a Notary Public in
and for the State of Iowa,personally appeared William F.I'eard to me personally known,and
who,being by me duly sworn,did say that he is the Mayor of the City of Waukee,Iowa;that the
seal affixed to the foregoing instrument is the corporate seal of the City,and that the instrument
was signed and sealed on behalf of the City,by authority of its City Council,as contained in the
Resolution No.07-253 adopted by the City Council on the 19'h day of November,2007,and that
William F;Peard acknowledges the execution of the instrument to be his voluntary act and deed
and the voluntary act 311ddeedof the City,by it and by him voluntarily executed .
