RESOLUTION 07-113
RESOLUTION APPROVING OFFER TO BUY REAL ESTATE AND ACCEPTANCE
AGREEMENT FOR PROPERTY LOCATED IN THE URBAN RENEWAL AREA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City Administrator executed an Offer to Buy Real Estate and Acceptance
Agreement (hereinafter referred to as the "Agreement")and said Agreement was accepted by the
Seller,James D.Clayton,on May 24,2007 for certain property legally known as the following:
That portion of the Southwest Quarter of Section 33 lying west of the 6th Street
in Waukee,all in Township 79 North,Range 26 West of the 5th P.M.,Dallas
County,Iowa;AND
WHEREAS,the City Council of the City of Waukee has deemed it to be in the best interest of
the City to purchase the property described above and that said property is now included in the
City's Urban Renewal Area;AND
WHEREAS,the proposed Agreement between James D.Clayton and the City of Waukee is
attached as Exhibit "A".
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee on this
11th day of June 2007 that the Offer to Buy Real Estate and Acceptance Agreement attached
hereto as Exhibit A is approved.
BE IT FURTHER RESOLVED that the City shall pay eamest money in the amount of $28,500
to the Brick Gentry Law Firm to be held in trust pursuant to said Agreement.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to executed said
Agreement on behalf of the City and the City Staff is directed to proceed in accordance with the
Agreement.
