RESOLUTION 07-146 1
APPROVING THE VACATING A PUBLIC UTILITY EASEMENT FOR PAINTED
WOODS PLAT 1,LOTS 16 AND 17
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the property owner of Painted Woods Plat 1,Lots 16 and 17,intends to construct a
residence that would be centered between the two lots;AND,
WHEREAS,when the lots in question were originally platted,a public utility easement was
granted for a portion of the shared property line between Lots 16 and 17,legally described as the
east thirty (30)feet ofthe west forty (40)feet of the south five (5)feet of Lot 16 and the east
thirty (30)feet of the west forty (40)feet of the north five (5)feet of Lot 17 all in Painted Woods
Plat 1;AND,
WHEREAS,the property owner in question has,at his expense,paid to have the public utilities
removed and relocated from the above legally described public utility easement;AND,
WHEREAS,on August 6,2007,the Waukee City Council held a public hearing at which time
no one present voiced any objection or submitted a written objection to the vacation of the above
legally described public utility easement;AND,
WHEREAS,City Staff agree that the above legally described public utility easement is no
longer necessary and should be vacated;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
6th day of August 2007 that it hereby approves the vacating of a public utility easement for
Painted Woods Plat 1,Lots 16 and 17.
