HomeMy WebLinkAbout1998-06-15-Resolutions 98-22_Eastern Area Pump Station - Final Res of NecessityRESOLUTION NO.98-22 Final Resolution of Necessity ~1 WHEREAS,this Council has adopted a preliminary resolution in accordance with Section 384.42 of the Code ofIowa,covering the Eastern Area Pump Station Project (the "Project");and WHEREAS,pursuant hereto,the Project Engineers have prepared preliminary plans and specifications,an estimated total cost of the work and a plat and schedule,including the valuation of each lot as determined by this Couocil,and the same have been duly adopted and are now on file with the City Clerk; NOW,THEREFORE,It Is Resolved by the City Couocil of the City of Waukee,Iowa: Section 1.It is hereby fouod and determined to be necessary and for the best interest of the City and its inhabitants to proceed with the Project,and to assess the cost or a portion thereof to the property benefitted thereby. Section 2.The Project shall constitute a single improvement and shall consist generally of the complete construction of a 0.26 mgd sewage pumping station located north in the service area, and a 6-inch force main extending westerly approximately 3,550 linear feet to an existing manhole of a gravity sewer.ISERVICEAREA An area in Section 36,Township 79 North,Range 26 West of the 5th Principal Meridian,Dallas County,Iowa,more particularly described as follows: Beginning at the southwest comer of the Southeast Quarter of the Southeast Quarter (SE 1/4 SE 1/4)of said Section 36;thence north along the west line ofthe Southeast Quarter of the Southeast Quarter (SE 1/4 SE 1/4)and the Northeast Quarter of the Southeast Quarter (NE 1/4 SE 1/4)of said Section 36 to the northwest comer of the Northeast Quarter of the Southeast Quarter (NE 1/4 SE 1/4)of said Section 36;thence east along the north line of the Southeast Quarter (SE 1/4)of said Section 36 to the northeast corner of the Southeast Quarter (SE 1/4)of said Section 36;thence south along the east line of the Southeast Quarter (SE 1/4)of said Section 36 to the southeast corner of the north three hundred thirty (330) feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 1/4 SE 1/4) of said Section 36;thence west along the south line of the north three hundred thirty (330) feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 1/4 SE 1/4) of said Section 36 to a point on the west line of said East Half (E Y2);thence south along the west line of the East Half ofthe Southeast Quarter of the Southeast Quarter (E Y2SE 1/4 SE 1/4)of said Section 36 to the northwest corner of the south three hundred twenty-six (326) feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2 SE 1/4 SE 1/4)j of said Section 36;thence east along the north line of said south three hundred twenty-six (326)feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y2SE 1/4 SE 1/4)to the northeast comer of the west four hundred (400)feet of the south three hundred twenty-six feet of the East Half of the Southeast Quarter of the Southeast Quarter (E Y,SE 1/4 SE 1/4)of said Section 36;thence south along the east line ofthe west four hundred (400)feet of the south three hundred twenty-six (326)feet ofthe East Half of the Southeast Quarter of the Southeast Quarter (E Y,SE 1/4 SE 1/4)of said Section 36 to a point on the south line of the Southeast Quarter (SE 1/4)of said Section 36;thence west along the south line of the Southeast Quarter (SE 1/4)of said Section 36 to the point of beginning,except for public rights-of-way and streets,containing 65.19 acres. It is considered that the following described property will be benefitted by the Project and should be specially assessed: An area in Section 36,Township 79 North,Range 26 West of the 5th Principal Meridian, Dallas County,Iowa,more particularly described as follows: The West Three-Quarters of the West Half of the Southeast Quarter of the Southeast Quarter (W 3/4 W Y,SE 1/4 SE 1/4)of said Section 36,including 14.25 acres,more or less. Section 4.Unless a property owner files objections with the City Clerk at the time of the hearing on this resolution of necessity,the property owner shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of using the special assessment procedure. Section 5.All resolution,parts of resolutions,or actions of the Council in conflict herewith are hereby repealed,to the extent of such conflict.
