HomeMy WebLinkAbout1997-06-16-Resolutions 97-21A_Cherry St Improvements 1997 - Set PHRESOLUTION NO.97-21A Setting a new date for hearing on the proposed Resolution of Necessity for the 1997 Street Improvements and Cherry Street Improvements Project WHEREAS,on June 2,1997,this Council adopted a proposed Resolution of Necessity for the 1997 Street Improvements and Cherry Street Improvements Project (the "Project")and scheduled the hearing thereon for June 23,1997,at 7:00 p.rn.at the City Hall;and WHEREAS,because of a problem in themailingoftheNoticetoPropertyOwners.itis necessary to reschedule the date for the hearing on the proposed Resolution of Necessity; NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa,as follows: Section 1.It is hereby found and determined to be necessary and for the best interest of the City to set a new date for hearing on the proposed Resolution of Necessity for the Project. Section 2.This Council will meet at 7:00 o'clock p.m.,on the 7fu day of July,1997, at the Waukee Public Library,in the City,at which time and place it will hear the property owners subj ect to the proposed assessment or assessments and interested parties for or against the Project,its cost,the assessment thereof or the boundaries of the properties to be assessed. Unless a property owner files objections with the City Clerk at the time of the hearing on the resolution of necessity,he shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of using the special assessment procedure. Section 3.The City Clerk is authorized and directed to give notice as required by Section 384.50 of the Code ofIowa by publication once each week for two consecutive weeks prior to the hearing in a newspaper published at least once weekly and having general circulation in the City.The first publication of such notice in such newspaper shall be not less than 10 nor more than 20 days prior to the hearing. Section 4.The City Clerk shall likewise mail a copy of such notice by regular mail to each property owner whose property is subject to assessment for the Project,as shown by the records in the office of the County Auditor not less than 15 days prior to the hearing on this resolution. Section 5.Such notice shall be in form substantially as follows: NOTICE TO PROPERTY OWNERS NOTICE IS GIVEN:That there are now on file for public inspection in the office of the City Clerk of the City of Waukee,Iowa,a proposed resolution of necessity,an estimate of cost and a plat and schedule showing the amounts proposed to be assessed against each lot and the valuation of each lot within a district approved by the City Council of Waukee,Iowa,for street improvements,described in general as the 1997 Street Improvements and Cherry Street Improvements Project,of the type and in the location as follows: 7"portland cement concrete or 8.5"asphaltic cement concrete pavement;9"portland cement concrete pavement;portland cement concrete sidewalk,grading,subgrade preparation,storm sewer pipe,intakes and other work incidental thereto,including cleanup,on and along certain streets in the City of Waukee,Iowa,as follows: DESCRIPTION OF IMPROVEMENTS 1997 STREET IMPROVEMENTS TI,e 1997 Street Improvements include constmction of a 25 foot wide street consisting of an 8 V.inch thick,20 foot wide asphaltic cement concrete pavement between 7 inch thick,2 %foot wide portland cement concrete curb and gutters over a 12 inch thick prepared subgrade for Northview Drive,Second Street and Third Street.Alternate construction for Nortlrview Drive,Second Street and Third Street would consist of a 7 inch thick,25 foot wide portland cement concrete pavement over a 12 inch thick prepared sub grade. Fifth Street will be constructed of a 9 inch tlrick,25 foot wide portland cement concrete pavement over a 12 inch thick prepared subgrade. TI,e 1997 Street Improvements also include pavement removal,excavation,fixture adjustment,storm sewer,intakes, sidewalk,driveway replacement and miscellaneous associated work. CHERRY STREET IMPROVEMENTS I Cherry Street Improvements include a 6 inch thick,24 foot wide asphaltic cement concrete pavement over a six inch thick granular subbase including subdrains.Improvements also include surfacing removal,storm sewer and miscellaneous associated work. It is considered that the property within the following described bouudaries will be specially benefited by this improvement and should be specially assessed: AREA OF ASSESSMENT An area in Section 33,Township 79 North,Range 26 West of the 5th Principal Meridian located in the City of Waukee,Iowa,more particularly described as follows: 1997 STREET IMPROVEMENTS Zone I -Northview Drive Beginning at a point that is one hundred forty-three (143.0)feet west and seventy (70.0)feet south of the center of Section 33,T79N,R26W,said point is also lying on the east right-of-way line of Fourth Street; thence easterly and parallel to the north right -of-way line of Northview Drive two thousand four hundred four and ninety-two hundredths (2,404.92)feet;thence southeasterly to the intersection of the southerly right-of-way line of Ashworth Drive and the northerly right-of-way line of Northview Drive as presentIy established;thence southeasterly along the southerly right-of-way line extended by Ashworth Drive to tile westerly right -of-way line extended of Warrior Lane;thence southerly along the west right-of-way line of Warrior Lane to a point that is seventy (70.0)feet north of the southeast corner of Lot 16 ofCoreue Acres Plat I in Section 33,T79N,R26W;thence westerly one thousand four hundred forty-two and eight tenths (1,442.8)feet to a point that is seventy (70.0)feet north of the southwest corner of Lot 32 of Corene Acres .. Plat I;thence northerly sixty (60.0)feetto the south right-of-way line of Northview Drive;thence westerly along said south right-of-way line two hundred twenty-six and five tenths (226.5)feet;thence southerly sixty (60.0)feet;thence westerly six hundred five and onc tenth (605.1)feetto a point that is seventy (70.0) feet north of the southwest corner of Lot 20 of Corene Acres Plat 2;thence northerly sixty (60.0)feet to tile south right-of-way line of Northview Drive;thence westerly along said south right-of-way line one hundred eighty (180.0)feetto the west right-of-way line extended of Third Street;thence southerly along the west right-of-way line ofTlrird Street to a point that is sixty (60.0)feet south of the south right-of-way line of Northview Drive;thence westerly two hundred eighty-nine and seventy-five hundredths (289.75)feet, more or less,to the east right-of-way line of Fourth Street,said point also lying sixty (60.0)feet south of the south right-of-way line of Northview Drive;thence northerly along the east right-of-way line of Fourth Street one hundred eighty (180.0)feet to the point ofbegiuuiog. Zone 4 -Fifth Street Beginniog at the northwest comer of Lot 5,Block 4 of the Original Town Plat of Waukee,Iowa;thence southeasterly perpendicular to the east right -of-way line of Fifth Street sixty (60.0)feet;thence southerly to the north line of the former depot ground lying south of Blocks 3 &4 and north of Blocks 7 &8 of the Original Town Plat of Waukee,Iowa;thence northwesterly along the north line of said former depot ground to a point that is sixty (60.0)feet distant of the east right-of-way line of Fifth Street;thence southwesterly parallel to the east right-of-way line of Fifth Street to 11,enorth right-of-way line of Ashworth Drive;thence northwesterly along said north right -of-way line one hundred seventy (170.0)feet to a point 111atis sixty (60.0)feet west of the west right -of-way line of Fifth Street;thence northerly along anirregnlar line parallel and distant sixty (60.0)feet to the west right-of-way line of Fifth Streetto a point on the south line of the former depot ground lying south of Blocks 3 &4 and north of Blocks 7 &8 of the Original Town Plat of Waukee,Iowa;thence northeasterly parallel to the west right-of-way line of Fifth Street tWO hundred thirty (230.0)feet to the north line of said former depot ground;thence southeasterly along the north line of said fanner depot ground to 11,ecenterline of Fifth Street;thence northeasterly along said centerline to the south right-of-way line extended by Maple Street;thence easterly along said south right-of-way line to the point ofbeginniog. ] CHERRY STREET IMPROVEMENTS Zone 5 -Cheny Street Beginning at a point that is sixty (60.0)feet north of the southwest comer of Lot 18,Block 15 of the Original Town Plat of Waukee,Iowa,said point also lying on the east right-of-way line of Sixth Street; thence easterly two hundred seventy-three (273.0)feet;thence southerly to a point lying sixty (60.0)feet south of the south right-of-way line of Cheny Street;thence westerly two hundred seventy-three (273.0) feet to 11,e east right -of-way line of Sixth Street;thence northerly along said east right -of-way line to the point of beginning. The Council will meet at 7:00 o'clock p.m.,on the 7ty day of July,1997,at the Waukee Public Library,Waukee,Iowa,at which time the owners of the property subject to assessment for the proposed improvement or any other person having an interest in the matter may appear and be heard for or against the making of the improvement,the boundaries of the district,the cost,the assessment against any lot or the final adoption of a resolution of necessity.A property owner will be deemed to have waived all objections unless at the time of hearing the property owner has filed objections with the City Clerk.
