Approving Detailed Plans and Specifications,Notice of Hearing,Notice to Bidders and
forms of Contract;and Setting Date for Hearing thereon and the Receipt of Bids therefor I
WHEREAS,this Council has adopted final Resolution of Necessity in connection with the
1997 Street Improvements and Cherry Street Improvements Project (the "Project");and
WHEREAS,detailed plans and specifications,notice of hearing and notice to bidders and
forms of contract have been prepared and filed by the Project Engineers for such project and have
been examined by this Council;and
WHEREAS,it is necessary to fix a time and place of public hearing on the proposed plans,
specifications and forms of contract and estimate of cost for the Project and to advertise for sealed
bids for the Project;
NOW,THEREFORE,Be It Resolved by the City Council of the City of Waukee,Iowa,as
follows:
Section I.The detailed plans and specifications,notice of hearing and notice to bidders
and forms of contract and estimate of cost referred to inn the preamble hereof are hereby approved.
Section 2.The amount of the bid security to accompany each bid is hereby fixed at ten
percent (10%)of the bid or a bid bond executed by a corporation authorized to contract as a surety in
the State ofIowa,in the penal sum often percent (10%)ofthe bid.
Section 3.The City Council hereby delegates to the City Clerk the duty of receiving,
opening and tabulating the bids for the construction of the Project,on the 30th day of July,1997,at
10:00 0'clock a.m.,at the Council Chambers,City Hall,Waukee,Iowa.The 4th day of August,
1997,at 7:00 o'clock p.m.,at the Council Chamber,Waukee,Iowa,is hereby fixed as the time and
place of hearing on the proposed plans,specifications,forms of contract and estimate of cost for the
Project,and also as the time and place of considering bids received by the City Clerk in connection
therewith.
Section 4.The City Clerk shall publish notice of hearing and notice to bidders,the same
being in the form hereinahove and substantially as attached to this resolution,which publication
shall be made in a legal newspaper of general circulation in the City,which publication shall be not
less than 4 days nor more than 20 days before the date set for hearing and receiving such bids.
Section 5.All resolutions or parts of resolutions in conflict herewith are hereby
repealed,to the extent of such conflict.
