Resolution of Necessity
WHEREAS,this Council has adopted a preliminary resolution in accordance with
Section 384.42 of the Code ofIowa,covering the 1997 Street Improvements and Cherry Street
Improvements Project (the "Project");and
WHEREAS,pursuant thereto,the Project Engineers have prepared preliminary plans and
specifications,an estimated total cost of the work and a plat and schedule,including the
valuation of each lot as determined by this Council,and the same have been duly adopted and are
now on file with the City Clerk;
NOW,THEREFORE,It Is Resolved by the City Council of the City ofWankee,Iowa:
Section I.It is hereby found and determined to be necessary and for the best interest
of the City and its inhabitants to proceed with the Project,and to assess the cost or a portion
thereofto the property benefitted thereby.
Section 2.The Project shall constitute a single improvement and shall consist
generally of the construction of'?"portland cement concrete or 8.5"asphaltic cement concrete
pavement;9"portland cement concrete pavement;portland cement concrete sidewalk,grading,
subgrade preparation,storm sewer pipe,intakes and other work incidental thereto on and along
certain streets in the City ofWankee,Iowa,as follows:
DESCRIPTION OF IMPROVEMENTS
1997 STREET IMPROVEMENTS
The 1997 Street Improvements include construction of a 25 foot wide street consisting of an 8 Yz
inch thick,20 foot wide asphaltic cement concrete pavement between 7 inch thick,2 Yz foot wide
portland cement concrete curb and gutters over a 12 inch thick prepared subgrade for Northview
Drive,Second Street and Third Street.Alternate construction for Northvicw Drive,Second
Street and Third Street would consist of a 7 inch thick,25 foot wide portland cement concrete
pavement over a 12 inch thick prepared subgrade.
Fifth Street will be constructed of a 9 inch thick,25 foot wide portland cement concrete
pavement over a 12 inch thick prepared subgrade,
The 1997 Street Improvements also include pavement removal,excavation,fixture adjustment,
storm sewer,intakes,sidewalk,driveway replacement and miscellaneous associated work.
CHERRY STREET IMPROVEMENTS
Cherry Street Improvements include a 6 inch thick,24 foot wide asphaltic cement concrete
pavement over a six inch thick granular subbase including subdrains.Improvements also include
surfacing removal,storm sewer and miscellaneous associated work.
It is considered that the property within the following described boundaries will be
specially benefitted by this improvement and should be specially assessed:
AREA OF ASSESSMENT
An area in Section 33,Township 79 North,Range 26 West of the 5th Principal Meridian located
in the City of Waukee,Iowa,more particularly described as follows:
1997 STREET IMPROVEMENTS
Zone 1 -Northview Drive
Beginning at a point that is one hundred forty-three (143.0)feet west and seventy (70.0)feet
south of the center of Section 33,T79N,R26W,said point is also lying on the east right-of-way
line of Fourth Street;thence easterly and parallel to the north right-of-way line of North view
Drive two thousand four hundred four and ninety-two hundredths (2,404.92)feet;thence
southeasterly to the intersection of the southerly right-of-way line of Ashworth Drive and the
northerly right-of-way line of Northview Drive as presently established;thence southeasterly
along the southerly right-of-way line extended by Ashworth Drive to the westerly right-of-way 1
line extended of Warrior Lane;thence southerly along the west right-of-way line of Warrior Lane
to a point that is seventy (70.0)feet north of the southeast corner of Lot 16 of Co rene Acres Plat
1 in Section 33,T79N,R26W;thence westerly one thousand four hundred forty-two and eight
tenths (1,442.8)feet to a point that is seventy (70.0)feet north ofthe southwest corner of Lot 32
of Corene Acres Plat 1;thence northerly sixty (60.0)feet to the south right-of-way line of
Northview Drive;thence westerly along said south right-of-way line two hundred twenty-six and
five tenths (226.5)feet;thence southerly sixty (60.0)feet;thence westerly six hundred five and
one tenth (605.1)feet to a pointthat is seventy (70.0)feet north of the southwest corner of Lot 20
ofCorene Acres Plat 2;thence northerly sixty (60.0)feet to the south right-of-way line of
Northview Drive;thence westerly along said south right-of-way line one hundred eighty (180.0)
feet to the west right-of-way line extended of Third Street;thence southerly along the west right-
of-way line of Third Street to a point that is sixty (60.0)feet sonth ofthe south right-of-way line
of North view Drive;thence westerly two hundred eighty-nine and seventy-five hundredths
(289.75)feet,more or less,to the east right-of-way line of Fourth Street,said point also lying
sixty (60.0)feet south of the south right-of-way line of Northview Drive;thence northerly along
the east right-of-way line of Fourth Street one hundred eighty (180.0)feet to the point of
beginning.
Zone 2 -Third Street
Beginning at a point that is sixty (60.0)feet west of the northeast corner of Lot 21 of Corene
Acres Plat 2:thence southwesterly to a point that is ten (10.0)feet west of the southeast corner of
Lot 22 of Corene Acres Plat 2;thence southerly one thousand ten (1,010.0)feet to a point that is 1
twenty (20.0)feet west and twenty (20.0)feet south of the northeast corner of Lot 62 of Co rene
Acres Plat 5;thence westerly one hundred eighty (180.0)feet to a point that is fourteen (14.0)
feet south of the north line of Lot 54 of Corene Acres Plat 5;thence northerly one thousand ten
(1,010.0)feet to a point that is sixty (60.0)feet west of the west right-of-way line of Third Street;
thence northeasterly parallel to said west right-of-way line to a point that is sixty (60.0)feet west
of the west right-of-way line of Third Street;thence easterly to the centerline of Third Street;
thence northeasterly along said centerline to the south right-of-way line extended of North view
Drive;thence easterly along said south right-of-way line to the point of beginning.
Zone 3A -Second Street
Beginning at a pint that is twenty-seven and five tenths feet west of the northeast corner of Lot
33 of Corene Acres Plat 1;thence southerly eight hundred nineteen and thirty-four hundredths
(819.34)feet to a point that is sixty (60.0)feet east of the east right-of-way line of Second Street;
thence westerly one hundred eighty (180.0)feet to a point that is forty-nine and thirty-four
hundredths (49.34)feet south of the north line of Lot 16 of Co rene Acres Plat 3;thence northerly
eight hundred nineteen and thirty-four hundredths (819.34)feet to a point that is nineteen (19.0)
feet east of the northeast corner of Lot 13 ofCorene Acres Plat 2;thence easterly along the south
right-of-way line of North view Drive one hundred eighty (180.0)feet to the point of beginning.
Zone 3B -Second Street (Curb and Gutter Improvements Only)
Beginning at a point that is twenty (20.0)feet west of the southwest corner of Lot 50 of Co rene
Acres Plat 4;thence westerly one hundred eighty (180.0)feet;thence northerly two hundred fifty
and sixty-six hundredths (250.66)feet;thence easterly one hundred eighty (180.0)feet;thence
southerly two hundred fifty and sixty-six hundredths (250.66)feet to the point of beginning.
Zone 4 -Fifth Street
Beginning at the northwest corner of Lot 5,Block 4 ofthe Original Town Plat of Waukee,Iowa;
thence southeasterly perpendicular to the east right-of-way line of Fifth Street sixty (60.0)feet;
thence southerly to the north line of the former depot ground lying south of Blocks 3 &4 and
north of Blocks 7 &8 ofthe Original Town Plat of Waukee,Iowa;thence northwesterly along
the north line of said former depot ground to a point that is sixty (60.0)feet distant of the east
right-of-way line of Fifth Street;thence southwesterly parallel to the east right-of-way line of
Fifth Street to the north right-of-way line of Ashworth Drive;thence northwesterly along said
north right-of-way line one hundred seventy (170.0)feet to a point that is sixty (60.0)feet west
ofthe west right-of-way line of Fifth Street;thence northerly along an irregular line parallel and
distant sixty (60.0)feet to the west right-of-way line of Fifth Street to a point on the south line of
the former depot ground lying south of Blocks 3 &4 and north of Blocks 7 &8 of the Original
Town Plat of Waukee,Iowa;thence northeasterly parallel to the west right-of-way line of Fifth
Street two hunched thirty (230.0)feet to the north line of said former depot ground;thence
southeasterly along the north line of said former depot ground to the centerline of Fifth Street;
thence northeasterly along said centerline to the south right-of-way line extended by Maple

CHERRY STREET IMPROVEMENTS
Zone 5 -Cherry Street
Beginning at a point that is sixty (60.0)feet north of the southwest comer of Lot 18,Block 15 of
the Original Town Plat of Waukee,Iowa,said point also lying on the east right-of-way line of
Sixth Street;thence easterly two hundred seventy-three (273.0)feet;thence southerly to a point
lying sixty (60.0)feet south of the south right-of-way line of Cherry Street;thence westerly two
hundred seventy-three (273 .0)feet to the east right-of-way line of Sixth Street;thence northerly
along said east right-of-way line to the point of beginning.
Section 3.It is hereby found and determined that there are now on file in the office of
the City Clerk an estimated total cost of the proposed work and a preliminary plat and schedule
showing the amount proposed to be assessed to each lot by reason of the Project.
Section 4.Unless a property owner files objections with the City Clerk at the time of
the hearing on this resolution of necessity,the property owner shall be deemed to have waived all
objections pertaining to the regularity of the proceedings and the legality of using the special
assessment procedure.
Section 5.All resolutions,parts of resolutions,or actions of the Council in conflict
herewith are hereby repealed,to the extent of such conflict.
