CITIES AND TOWNS CERTIFICATION OF MUNICIPAL CORPORATE
RESOLUTIONS SALE OF REAL PROPERTY AND DELIVERY OF
CONVEYANCE
I,the undersigned,Kurt A.Rueckel,City Clerk of the City of Waukee,Iowa,a municipal corporation
duly organized and existing under the laws ofthe State ofIowa,DO HEREBY CERTIFY that notice
of a pending sale of real estate has been published at least once,not less than four or more than twenty
days before the date of the hearing in a newspaper published at least once weekly and having general
circulation in the City of Waukee,Dallas County,Iowa,in accordance with the Code ofIowa,that a
public hearing has been held and the following is a true and exact transcript of certain resolutions duly
adopted by the members of the City Council on the 20th day of October,1997,by the call of yeas and
nays recorded below and these resolutions are now in full force and effect:
RESOLVED,that this municipal corporation is hereby authorized to sell,grant and convey certain
City property to the State ofIowa for MUTUAL BENEFIT and other certain benefits,terms and
conditions as set forth in a Partial Acquisition Contract signed by Kurt A.Rueckel,City
Clerk/Administrator,dated May 20,1997,relating to Dallas County Project No.STPN-6-3(43)--2J-25,
Parcel No.86,and as more particularly described in a certain Quitclaim Deed and the Acquisition Plat
designated Exhibit "A"attached to the Quitclaim Deed.
RESOLVED FURTHER,that Donald L.Bailey,Mayor and Kurt A.Rueckel,City
Clerk/Administrator,have been empowered and directed to execute,acknowledge,and deliver in the
name of this Municipal Corporation,the Quitclaim Deed and any other instruments of title required by
law or which may,in the judgement of such officer(s),be necessary or desirable to effectuate the sale,
grant and conveyance of the property to the State ofIowa.
RESOLVED FURTHER,Kurt A.Rueckel,is hereby directed to deliver the executed Quitclaim Deed
to the Project Development division of the Iowa Department of Transportation Closing Agent in
exchange for the consideration of MUTUAL BENEFIT and other valuable considerations,and said
Quitclaim Deed is hereby accepted and approved by this municipal corporation,as authorized in
accordance with the Code of Iowa.
IN WITNESS WHEREOF,I have hereunto subscribed by name at Waukee,Iowa,this 20th day of
October,1997.
