HomeMy WebLinkAbout1999-02-01-Resolutions 99-07_Bonds - GO Loan Agr - Set PHRESOLUTION NO.99-07 TO FIX A DATE FOR PUBLIC HEARING ON LOAN AGREEMENTS WHEREAS,the City of Waukee,in the County of Dallas,State of Iowa (the "City"), proposes to enter into a general obligation loan agreement (the "General Obligation Loan Agreement")in a principal amount not to exceed $2,500,000 pursuant to the provisions of Section 384.24A of the Code ofIowa for the purpose of paying the cost,to that extent,of the construction of certain street and sanitary sewer improvements,including the refunding of outstanding Warrants previously issued by the City to pay costs in connection therewith;and the acquisition of fire department and emergency warning equipment,and it is necessary to fix a date of meeting of the Council at which it is proposed to take action to enter into the General Obligation Loan Agreement and to give notice thereof as required by such law;and WHEREAS,heretofore and in strict compliance with the provisions of Chapter 384 of the Code of Iowa,the City confirmed and levied special assessments on various lots and tracts of land within the City by reason of its University Avenue Trunk Sewer Project (hereinafter referred to as the "Sewer Project"),such assessments totaling the sum of $927,210.34,of which amount there are assessments totaling $329,082.61 which are currently outstanding;and WHEREAS,the City proposes to enter into a loan agreement (the "Special Assessment Sewer Loan Agreement")in the principal amount of $297,000 pursuant to the provisions of Section 384.24A of the Code ofIowa for the purpose of paying the cost,to that extent, of the Sewer Project,including the refunding of outstanding Warrants previously issued by the City to pay costs in connection therewith,and it is necessary to fix a date of meeting of the Council at which it is proposed to take action to enter into the Special Assessment Sewer Loan Agreement and to give notice thereof as required by such law; and ] WHEREAS,heretofore and in strict compliance with the provisions of Chapter 384 of the Code ofIowa,the City confirmed and levied special assessments on various lots and tracts of land within the City by reason of its 1997 Street Improvements and Cherry Street Improvements Project (hereinafter referred to as the "Street Project"),such assessments totaling the sum of $193,807.06,of which amount there are assessments totaling $114,375.25 which are currently outstanding;and WHEREAS,the City proposes to enter into a loan agreement (the "Special Assessment Street Loan Agreement")in the principal amount of $103,000 pursuant to the provisions of Section 384.24A of the Code ofIowa for the purpose of paying the cost,to that extent, of the Street Project,including the refunding of outstanding Warrants previously issued by the City to pay costs in connection therewith,and it is necessary to fix a date of meeting of the Council at which it is proposed to take action to enter into the Special Assessment Street Loan Agreement and to give notice thereof as required by such law;I NOW,THEREFORE,Be It Resolved by the City Council of the City of Waukee,Iowa, as follows: Section 1.This Council shall meet on the 15th day of February,1999,at the City Hall,in the City,at 7:00 o'clock p.ll.,at which time and place a hearing will be hel d and proceedings will be instituted and action taken to enter into the General Obligation Loan Agreement,the Special Assessment Sewer Loan Agreement and the Special Assessment Street Loan Agreement (hereinafter sometimes referred to collectively as the "Loan Agreements"). Section 2.The City Clerk is hereby directed to give notice of the proposed action on each of the Loan Agreements setting forth the amount and purpose thereof,the time when and place where the said meeting will be held by publication at least once and not less than 4 nor more than 20 days before the meeting,in a legal newspaper which has a general circulation in the City.The notices shall be in substantially the following form: NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER INTO A GENERAL OBLIGATION LOAN AGREEMENT AND BORROW MONEY IN A PRINCIPAL AMOUNT NOT TO EXCEED $2,500,000 (GENERAL OBLIGATION) The City Council of the City of Waukee,Iowa,will meet on the 15th day of February, 1999,at the City Hall,in the City,at 7:00 o'clock p.m.,for the purpose of instituting proceedings and taking action to enter into a general obligation loan agreement (the "General Obligation Loan Agreement")and borrow money in a principal amount not to exceed $2,500,000 for the purpose of paying the cost,to that extent,of the construction of certain street and sanitary sewer improvements,including the refunding of outstanding Warrants previously issued by the City to pay costs in connection therewith;and the acquisition of fire department and emergency warning equipment. The General Obligation Loan Agreement is proposed to be entered into pursuant to authority contained in Section 384.24A of the Code ofIowa and will constitute a general obligation of the City. At the aforementioned time and place,oral or written objections may be filed or made to the proposal to enter into the General Obligation Loan Agreement.After receiving objections,the City may determine to enter into the General Obligation Loan Agreement, in which case,the decision will be final unless appealed to the District Court within fifteen (15)days thereafter.
