TRUNK SEWER SPECIAL ASSESSMENT AND WAIVING OF INTERTEST ON
CERTAIN PROPERTIES RELATING THERETO
WHEREAS,the City of Waukee has levied an assessment totaling $927,210.34 for the
University Avenue Trunk Sewer Project on an area in Sections 33,34,35,and 36,
Township 79 North,Range 26 West of the 5tl'Principal Meridian and Sections 3 and 4,
Township 78 North,Range 26 West of the 5th Principal Meridian,Dallas County,Iowa;
and
WHEREAS,the City of Waukee passed a Resolution 98-56 on November 2,1998
Adopting Final Assessment Schedule for the University Avenue Trunk Sewer Project and
Amending,Confirming and Levying the Assessments;and
WHEREAS,Notice of Filing of Final Assessment Schedule for the University Avenue
Trunk Sewer Project was been twice published and sent to all property owners effected
thereby;and
WHEREAS,the Special Assessment Statement for University Avenue Trunk Sewer
Project requires amendment to accurately reflect interest free payments made on said
Proj ect;and
JWHEREAS,the City of Waukee has received previously uncertified payments for the
following parcels within the area of assessment for the University Avenue Trunk Sewer
Project:
Parcel 500-00580-0000 legally described as:
13.75 acres in the northeast corner of the north 870'of the southeast quarter
of the southeast quarter Section 33,T79N,R26W
Parcel 500-00584-0000 legally described as:
Irregular 20.42 acres of the north 1,727.47'of the southwest quarter that is
south and west of Ashworth Drive,more or less,in Section 34,T79N,
R26W;
Parcel 510-00029-0000 legally described as:
East half of the southwest quarter east of the center of Ashworth Drive &
south of the railroad in Section 34,T79N,R26W;
Parcel 510-00042-0000 legally described as:
Parcel A of the southwest quarter of the southeast quarter in Section
35,T79N,R26W;
Parcel 510-0090-0100 legally described as:I
Outlot E of Country Club Woods Plat 4 in Section 36,T79N,R26W;
and
WHEREAS,the afore mentioned parcels 500-00580-0000;500-00584-0000;500-
00029-0000;500-00584-0000;500-00042-0000;and 500-0090-0100 were inadvertently
left off of the final Special Assessment Statement as paid when certified to the Office of
the Treasurer of Dallas County,Iowa;and
WHEREAS,payment has been made to the Dallas County Treasurer for the following
parcels:
500-00584-0000 legally described as:
The north 545'of the south 1,457.53'of the east 790'of the west
840'of the southwest quarter,more or less,in Section 34,T79N,
R26W;
510-00023-0100 legally described as:
Parcel B in the west half of the southeast quarter lying south of the
railroad in Section 34,T79N,R26W;
510-00023-0200 legally described as:
Parcel A,described as the east 1/2 of the southeast quarter lying south
of the railroad and the east 3 acres of the west half of the southeast
quarter lying south of the railroad in Section 34,T79N,R26W;and
NOW THEREFORE,BE IT RESOLVED that the Waukee City Council does hereby
certify that all financial obligations in regards to the University Trunk Sewer Project have
been met by the owners of the following parcels:
Parcel 500-00580-0000 legally described as:
13.75 acres in the northeast corner of the north 870'of the southeast quarter of the
southeast quarter Section 33,T79N,R26W
Parcel 500-00584-0000 legally described as:

Parcel 510-00029-0000 legally described as:

R26W;
Parcel 510-0090-0100 legally described as:

Parcel 510-00023-0100 legally described as:
Parcel B in the west half of the southeast quarter lying south of the rail road In
Section 34,T79N,R26W;
Parcel 510-00023-0200 legally described as:
Parcel A,described as the east 1/2 of the southeast quarter lying south of the
rail road and the east 3 acres of the west half of the southeast quarter lying south of
the railroad in Section 34,T79N,R26W;and
BE IT FURTHER RESOLVED,that the City of Waukee forgives all interest previously
consider owed on said property and does certify that the total amount of
assessments paid in cash (including assessments of less than $50.00)on the
University Avenue Trunk Sewer Special Assessment is $606,772.92.The total amount
of unpaid assessments remaining to be spread being $320,437.42 with interest accrued
thereupon.The Council does hereby instruct the City Clerk to make said changes to the
Special Assessment Statement for the University Trunk Avenue Sewer Project and file
said changes at the Office of the Treasurer in the County of Dallas,Iowa.)
