AGREEMENTS
WHEREAS,pursuant to the provisions of Section 384.24A of the Code ofIowa,the City
of Waukee,in the County of Dallas,State ofIowa (hereinafter referred to as the "City"),
has heretofore proposed to contract indebtedness and enter into a loan agreement (The
"General Obligation Loan Agreement")in a principal amount of not to exceed
$2,500,000 for the purpose of paying the cost,to that extent,of the construction of certain
street and sanitary sewer improvements,including the refunding of outstanding Warrants
previously issued by the City to pay costs in connection therewith:and the acquisition of
fire department and emergency warning equipment,and has published notice of the
proposed action and has held a hearing thereon;and
WHEREAS,pursuant to the provisions of Section 384.24A of the Code ofIowa,the City
has also heretofore proposed to contract indebtedness and enter into a loan agreement
(the "Special Assessment Sewer Loan Agreement")in a principal amount not to exceed
$297,000 for the purpose of paying the cost,to that extent,of the City's University
Avenue Trunk Sewer Project,including the refunding of outstanding Warrants previously
issued by the City to pay costs in connection therewith,and has published notice of the
proposed action and has held a hearing thereon;and
JWHEREAS,pursuant to the provisions of Section 384.24A of the Code ofIowa,the City
has also heretofore proposed to contract indebtedness and enter into a loan agreement
(the "Special Assessment Street Loan Agreement")in a principal amount not to exceed
$103,000 for the purpose of paying the cost,to that extent,of the City's 1997 Street
Improvements and Cherry Street Improvement Project,including the refunding of
outstanding Warrants previously issued by the City to pay costs in connection therewith,
and has published notice of the proposed action and has held a hearing thereon;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa,
as follows:
Section 1.The Council hereby determines to enter into the General
Obligation Loan Agreement,the Special Assessment Sewer Loan Agreement and the
Special Assessment Street Loan Agreement with Ruan Securities Corporation,Des
Moines,Iowa,in the future and declares that this resolution constitutes the "additional
action"required by Section 384.24A of the Code oflowa.
Section 2.All resolutions and orders or parts thereof in conflict with the
provisions of this resolution,to the extent of such conflict,are hereby repealed.
Section 3.This resolution shall be in full force and effect immediately upon
its adoption and approval,as provided by law.I
