HomeMy WebLinkAbout1999-04-19-Resolutions 99-41_Carter Subdivision - PlatRESOLUTION 99-41 )ACCEPTING PLAT OF CARTER SUBDIVISION WHEREAS,Catherine J.Carter,a single person,has caused to be platted certain real estate,lying within two (2)miles of the corporate limits of the City of Waukee, Dallas County,Iowa,and which Plat is now on file in the office of the Director of Planning and Zoning for Dallas County,Adel,Iowa,and which plat covers the following described real estate,to-wit: A subdivision of TRACT "B"of the Northeast Quarter (NE v.)of Section 8, Township 79,North,Range 26 West of the 5th P.M.,Dallas County,Iowa. Recorded as Plat of Survey,Book 724,Page 27 in the Dallas County Recorders Office,described as follows: Commencing at the Northeast corner of said Northeast Quarter (NW v.);thence N 89°07'00"W,343.82 feet along the North line of said Northeast Quarter (NE v.) to the point of beginning;thence S 00°02'21"E,725.55 feet;thence S 62°23' 44"W,449.21 feet;thence S 89°28'26"W,208.02 feet;thence N 33°55'24"W, 235.30 feet;thence N 6°11'54"E,754.88 feet to the North line of said Northeast Quart (NE v.);thence S 89°07'00"E,655.48 feet along the North line of said Northeast Quarter (NE v.)to the point of beginning;containing 13.960 acres more or less,including 0.498 acres of public road right of way,subject to easements and restrictions of record.} and WHEREAS,said Plat subdivides the aforesaid real estate into two (2)lots numbers from Lot One (1)to Lot Two (2);and WHEREAS,said Plat is also accompanied by the following: 1.Abstract of Title from Government Entry to date. 2.Attorney Charles H.Fagen's legal opinion that said abstract shows merchantable fee simple title to the above described tract to be vested in the proprietor,Catherine J.Carter. and WHEREAS,full compliance has been had with the laws of the State of Iowa for platting of said TRACT "B",a subdivision to Waukee,Iowa,specifically including sections 114A.8,409A.6,and 409A.1l of the Code of Iowa,and including approved thereof action thereon by the City of Waukee Planning and Zoning Commission after following proper published notice of hearing.I NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa,that the aforesaid Plat of Carter Subdivision,a subdivision within two (2) miles of the city limits of Waukee,Iowa,together with the Plat thereof be accepted by the City of Waukee,Iowa. BE IT FURTHER RESOLVED that the aforesaid plat attached hereto be and the same is hereby approved and the Mayor and the Clerk of the City of Waukee,Iowa,be and they are hereby directed to certify this Resolution affixed to the aforesaid Plat for the purpose of filing the same with the Recorder ofDaIIas County,Iowa,as required by law.
