RESOLUTION NO.99-63
Approving a Lease-Purchase Agreement
WHEREAS,pursuant to the provisions of Section 364.4 of the Code of Iowa,the
City of Waukee,in the County of Dallas,State of Iowa (hereinafter referred to as the
"City")has heretofore proposed to contract indebtedness and enter into a Lease-Purchase
agreement (the "Lease-Purchase Agreement")in the principal amount of$25,611,for the
purpose of acquiring data hardware and software for City Hall,and the City Clerk has
caused notice of the proposed action to be published and the Council has held a hearing
thereon;and
WHEREAS,the life of data hardware and software equipment in question is at
least twice the terms of the lease set forth;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,
Iowa,as follows:
Section 1.The action taken by the City Clerk in having the notice of the
Council's proposal to enter into the Lease-Purchase Agreement published is hereby
ratified and confirmed.
Section 2.Lease-Purchase Agreement with Convergent Capital Corporation,
6300 S.Syracuse Way,Suite 290,Englewood,Colorado 80111,in substantially the form
as has been presented to and considered by this Council and containing substantially the
same terms and provisions set forth therein,is hereby approved,and the Mayor and City
Clerk are hereby authorized and directed to execute and deliver the Lease-Purchase
Agreement and to execute any and all documents and do any and all things deemed
necessary in order to accomplish the purposes of the Lease-Purchase Agreement.
Section 3.All resolutions and orders or parts thereof in conflict with the
provisions of this resolution,to the extent of such conflict,are hereby repealed.
Section 4.This resolution shall be in full force and effect immediately upon
its adoption and approval,as provided by law.
