)Determining costs of the City's University Avenue Trunk Sewer Project,ordering
payment to the contractor and directing preparation of the final assessment plat
and schedule
WHEREAS,the Project Engineers have duly filed a certificate of completion in
accordance with Section 384.58 of the Code of Iowa for the University Avenue Trunk
Sewer Project (the "Project"),and the City has accepted the Project;and
WHEREAS,the Project Engineers have now filed the final estimate of cost for
the Project showing the total costs thereof;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,
Iowa,as follows:
1.Section 2.It is hereby found and determined that the total cost of said Project
is in the total amount of $1,506,363.41,of which the sum of $927,210.34 shall be
assessed against private property within the assessable district.
Section 3.Except for the amount being retained by the City pursuant to
Chapter 573 of the Code ofIowa,which shall be paid to the contractor not less than 30
days after the acceptance of the work,the amount due the contractor is hereby ordered
paid either through the issuance of an anticipatory warrant or warrants,in accordance
with Section 384.57 of the Code of Iowa,or from available funds from which payment
for the work may be made.

Section 4.All resolutions or parts of resolutions in conflict herewith be and
the same are hereby repealed,to the extent of such conflict.
Section 5.The Project Engineers are hereby instructed to prepare the final
plat and schedule of assessments,as provided in Section 384.59 of the Code ofIowa.
