RESOLUTION OF NECESSITY
WHEREAS,this Council has adopted a preliminary resolution in accordance with Section
384.42 of the Code ofIowa,covering the University Avenue Trunk Sewer Project (the
"Project");and
WHEREAS,pursuant thereto,the Project Engineers have prepared preliminary plans and
specifications,an estimated total cost of the work and a plat and schedule,including the
valuation of each lot as determined by this Council,and the same have been duly adopted and are
now on file with the City Clerk;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa:
Section I.It is hereby found and determined to be necessary and for the best interest of the
City and its inhabitants to proceed with the Project,and to assess the cost or a
portion thereof to the property benefitted thereby.
Section 2.The Project shall constitute a single improvement and shall consist generally of
the following construction and other work incidental thereto in the following
locations in the City:
The project generally consists of the complete construction of a 3.0 mgd sewage pumping station
located south of the existing sewage disposal ponds with a 12 inch force main extending
northwesterly approximately 1,500 linear feet to the head ofthe existing treatment facilities.
Improvements include a 12 to 18 inch gravity sewer from said pump station extending easterly
approximately 11,700 linear feet along the north side of University Avenue to the "T"
intersection of Waco Place.Also included is a 1.0 mgd sewage pumping station located north of
University Avenue and west of future Westwoods Drive and a 12 inch force main extending
westerly along the north side of University Avenue approximately 4,700 linear feet to the eastern
terminus of the proposed trunk sewer.
The improvements were divided into two key segments labeled 1 and 2.Segment 1 generally
consists of the 3.0 mgd pumping station,1,500 linear feet of 12 inch force main and
approximately 4,500 linear feet of 18 inch gravity sewer.Segment 1 is located from the existing
sewage treatment facilities northeasterly along the north side of an unnamed creek to
approximately 840'east of the west line of Section 34,T79N,R26W.Segment 2 generally
consists of approximately 7,200 linear feet of 12 to 15 inch gravity sewer along the north side of
University Avenue extending east from the eastern terminus of Segment 1 and ends at the
southeast corner of the southeast quarter of the southwest quarter of Section 35,T79N,R26W.
Segment 2 also includes the 1.0 mgd pumping station located north of the southeast comer of the
southwest quarter ofthe southwest quarter of Section 36,T79N,R26W.Approximately 4,700
linear feet of 12 inch force main running along the north side of University Avenue will join the
eastern terminus of the 12 to 15 inch gravity sewer to the 1.0 mgd pumping station.
It is considered that the property within the following described boundaries will be specially
benefitted by this improvement and should be specially assessed:
An area in Sections 33,34,35,and 36,Township 79 North,Range 26 West of the 5th Principal
Meridian and Sections 3 and 4,Township 78 North,Range 26 West of the 5th Principal
Meridian,Dallas County,Iowa,more particularly described as follows:
Commencing at a point one thousand three hundred eighteen and nine tenths (1,318.9)
feet more or less,west of the southeast comer of Section 33,T79N,R26W,said point
also being the southwest comer of the 13.5 acres in the southern portion of the southeast
quarter of the southeast quarter of Section 33,T79N,R26W;thence northerly four
hundred fifty -seven and thirty-two hundredths (457.3 2)feet thence easterly three hundred
fifty and seven tenths (350.7)feet;thence northerly three hundred eighteen (318.0)feet;
thence northeasterly three hundred sixty-three and six tenths (363.6)feet;thence
northerly seven hundred forty-seven (747.0)feet;thence easterly six hundred thirty-six
and thirty-six hundredths (636.36)feet to the west line of Section 34,T79N,R26W;
thence southerly two hundred fifty (250.0)feet more or less,along the west line of said
Section 34;thence easterly eight hundred forty (840.0)feet;thence northerly to the south
right-of-way line of the Chicago and Northwestern railroad;thence southeasterly along
said south right-of-way to the northeast corner of the east 3 acres lying south of the
railroad of the southwest quarter of the southeast quarter of Section 34,T79N,R26W;..
thence northerly to the northwest corner of the southeast quarter of the southeast quarter
of Section 34,T79N,R26W;thence easterly to the southwest comer ofthe northeast
quarter of the southeast quarter of Section 35,T79N,R26W;thence northerly to the '.,
northwest corner of northeast quarter of the southeast quarter of Section 35,T79N,
R26W;thence easterly to a point that is seven hundred twenty-six (726.0)feet west of the
east quarter corner of Section 35,T79N,R26W,thence southerly five hundred (500.0)
feet south and two hundred thirty-three (233.0)feet west of the east quarter comer of said
Section 35;thence southerly two hundred (200.0)feet to the southwest corner of Lot 2 of
Seven Pines Plat 1 of the northeast quarter of the southeast quarter of Section 35,T79N,
R26W;thence easterly one hundred ninety-five and seventy-one hundredths (195.71)
feet;thence northeasterly along a curve to the northeast comer of Outlot Y of Seven Pines
Plat 1 of the northeast quarter of the southeast quarter of Section 35,T79N,R26W;
thence southerly to the southeast corner of said Outlot Y;thence northwesterly along a
curve to the southeast corner of Outlot Z of Seven Pines Plat 1 of the northeast quarter of
the southeast quarter of Section 35,T79N,R26W;thence westerly one hundred ninety-
five and eighty-one hundredths (195.81)feet to the southwest corner of said Outlot Z;
thence southerly two hundred (200.0)feet to the southwest corner of Lot 4 of Seven Pines
Plat 1 of the northeast quarter of the southeast quarter of Section 35,T79N,R26W;
thence westerly forty-five (45.0)feet;thence southerly three hundred fifty-seven and
fifteen hundredth (357.15)feet;thence easterly two hundred seventy-eight (278.0)feet to
the west line of Section 36 T79N,R26W;thence northerly along the west line of said
Section 36 to a point that is six hundred sixty-nine and seventy-six hundredths (669.76)
feet south of the northwest corner of the northwest quarter of the southwest quarter of
said Section 36;thence easterly seven hundred sixty-three (763.0)feet;thence
northeasterly six hundred seventy-nine and forty-six hundredths (679.46)feet;thence
easterly to the northeast comer of the northwest quarter of the southwest quarter of
Section 36,T79N,R26W;thence southerly to the southeast comer of the southwest
quarter of the southwest quarter of said Section 36;thence westerly to the southwest
corner of the southwest quarter ofthe southeast quarter of Section 35,T79N,R26W;
thence southerly to the north right-of-way line of the Chicago and Northwestern railroad;
thence northwesterly along said north right-of-way line to the south line of Section 34,
T79N,R26W;thence westerly to the point of beginning,except for public rights-of-way,
streets,and railroads containing 453.81 acres,more or less.
Section 3.It is hereby found and determined that there are now on file in the office of the
City Clerk an estimated total cost of the proposed work and a preliminary plat and
schedule showing the amount proposed to be assessed to each lot by reason of the
Project.
Section 4.Unless a property owner files objections with the City Clerk at the time of the
hearing on this resolution of necessity,the property owner shall be deemed to
have waived all objections pertaining to the regularity of the proceedings and the
legality of using the special assessment procedure.
Section 5.All resolutions,parts of resolution,or actions of the Council in conflict herewith
are hereby repealed,to the extent of such conflict.
