HomeMy WebLinkAbout1999-10-04-Resolutions 99-121_Rezoning - Set PHCITY OFWaukee.II.THE KEY TO GOOD LIVING RESOLUTION NO.99-121 To fix a date for a public hearing on an amendment to the Zoning Ordinance of the City of Waukee,Iowa in relation to and affecting the property located at 750 142nd Street WHEREAS,the City of Waukee,in the County of Dallas,State ofIowa (hereinafter referred to as the "City"),did heretofore establish a Zoning Ordinance;and WHEREAS,the City Council of the City of Waukee is vested with the authority to amend said Zoning Ordinance;and WHEREAS,the City Council proposes make such a change to the Zoning Ordinance that is in conformity with the City's Comprehensive Plan and serves the common interest of the community; NOW,THEREFORE,Be It Resolved by the City Council ofthe City of Waukee,Iowa,as follows: Section 1.This Council shall meet on the 4th day of October,1999,at the City Hall,in the City,at 7:00 o'clock p.m.,at which time and place a hearing will be held and proceedings will be instituted and action taken to amend the zoning ordinance. Section 2.The City Clerk is hereby directed to give notice ofthe proposed action on the amendment of the zoning ordinance setting forth the purpose thereof,the time when and place where the said meeting will be held,by publication at least once,and not less than 4 nor more than 20 days before the meeting,in a legal newspaper which has a general circulation in the City.The notice shall be in substantially the following form: PUBLIC HEARING -ZONING CHANGE HEARING FOR THE CITY OF WAUKEE The Waukee City Council will hold a hearing on October 19,1999 at 7:00pm at the City Hall,230 Highway 6.The purpose of the hearing is to consider an amendment to the Zoning Ordinance by changing the following described parcel known informally as 750 NW l42nd Street from A-I (agricultural district)to R-l (Single Family Residential District),legally described as follows: The North 330.00 feet of the East Y,of the SE.Yo of the SE.Yo of Section 36 T79N R 26 West of the 5th P.M., Waukee Dallas County,Iowa.Described as follows:Conunencing at the East Yo Corner of said Section 36;Thence S 00-OO'-OO"W,a distance of 1317.31 feet the Point of Beginning;Thence S OO-OO'-OO"W,along the East line of the SE. Yo ofthe SE.Yo of said Section 36,a distance of330.00 feet;Thence S 89-46'-45"W,a distance of 661.48 feet;Thence N 00-02'-13"E,a distance of330.00 feet,to the East line of the SE.Yo of the SE.Yo of said section 36,and to the point of Beginning,snbject to a 33.00 feet wide public road easement along the East side thereof. Said tract of land being subject to and together with any and all easements or record. Said tract ofland contains 5.01 acres more of less,including said easements. And to amend the Official Zoning Map and republish said map to reflect the current zoning in the City of Waukee,Dallas County,Iowa. Interested individuals are encouraged to attend the public hearing and offer their opinions,either pro or con,to the proposed amendment. By order of the City Council of the City of Waukee,Iowa.
