RESOLUTION NO.99-130
APPROVAL WAUKEE COMMUNITY CENTER RULES AND REGULATIONS
OF ACCEPTANCE OF CONTRACT FOR USE OF WAUKEE COMMUNITY
CENTER
WHEREAS,the City Council of the City of Waukee believes it is in the interest
of the City to have rules and regulations and a contract for use of Waukee Community
Center;and
WHEREAS,City Staff has prepared rules and regulations and a contract for said
purpose.
NOW THEREFORE,BE IT RESOL YED that the City Council of the City of
Waukee does hereby approve the rules and regulations and contract attached hereto;and
order the execution and filing of said contract.
Section 1.Contract:
WAUKEE COMMUNITY CENTER RULES AND REGULATIONS
1.Introduction
The City of Waukee (hereinafter "The City")strongly supports the citizens of
Waukee using the Waukee Community Center (hereinafter "Center"),located at
410 6'h Street.
This document outlines policies and guidelines for community use of the Center.
The guidelines have been reviewed by the City,and approved by the Parks and
Recreation Board and City Staff.
II.Elligibility
All local civic,religious,fraternal,political,patriotic and community welfare
organizations,including any individuals or groups interested in promoting
cultural,educational,recreational,social or economic activities are eligible to use
the Center.
The use of the Center for partisan,political or sectarian purposes may be granted.
The use of the Center does not imply the endorsement or sponsorship by the City.
III.Administration Guidelines )
All users of the Center must comply with all federal,state,and municipal equal
opportunity laws and regulations prohibiting discrimination.All users of the

with City policies.
N.Liability
The City requires a signed contract from all renters.All community groups are
responsible for their own insurance coverage and the City may require a
certificate of insurance to demonstrate adequate liability insurance coverage.
V.Supervision
Each group is responsible for behavior of its members.Each group must
designate one person who serves as a group contact person with the Center
coordinator.The group representative is responsible for communicating the
Center guidelines,procedures and communication to the group members and for
ensuring that group members understand and follow those guidelines and
procedures.1
VI.Capacity
The maximum number of people permitted in the Center is 96.
VII.Tobacco
There will be no tobacco usage allowed at any time in the Center.
VIII.Time
Half-Day:6:00AM -2:00PM or 4:00PM -Midnight
Full-Day:6:00AM to Midnight
Section 2.Contract:
CONTRACT OF USE OF WAUKEE COMMUNITY CENTER
The Waukee Community Center (hereinafter "Center")is made available to
persons in the community for their pleasure during the times that it is open and not
reserved by community civic organizations.The Center may be reserved without charge
for non-profit civic and charitable organizations.Other organizations and individuals
reserving the Center will be subject to the following contract.1
In consideration of the use of the Center,the undersigned (herein referred to as
"Renter")hereby agrees with the City of Waukee,Iowa,(herein referred to as City)as
follows:
1.RESIDENT STATUS.To be considered a resident of Waukee,you must
have a Waukee address,either in in-town or ruraL The Waukee Post
Office must deliver your mail.There will be no exceptions to this rule.
2.RENT.Renters with resident status shall pay $25 for a half-day,$50 for a
full day,as payment to reserve and use the Center.Non-resident renters
shall pay $300 for a full day,$150 for a half-day,as payment to reserve
and use the Center.
3.DEPOSIT.Renters must pay the deposit of $150 (Residents),$300 (Non-
Residents)before the Center will be reserved for them.This can be
accomplished by coming to Waukee City Hall with a personal check,
business check or money order,or by mailing a personal check,business
check or money to:

4.DEPOSIT REFUNDS.Deposits for residents will be refunded if City
Hall receives written notification thirty (30)days prior to the day for
which the Center is reserved.No deposit will be refunded due to
cancellation for non-residents.
5.CLEANING AND RESTORATION.All renters will clean the Center
and all facilities therein after renter's use,and restore the Center to its
condition existing prior to the renter's occupancy.Restoration includes
restoring furnishings to their location existing prior to renter's use.
6.DAMAGES.Renter hereby agrees to indemnify and compensate City for
any damages occurring to the Center during renter's occupancy or during
occupancy of guests of renter during the rental period.
7.DEPOSIT FORFEITED FOR DAMAGES OR FAILURE TO
CLEAN OR RESTORE.If,in the judgement of the City,the Center is
not adequately cleaned and restored,or if there is damage to the Center,
City may withhold any or all of the deposit paid by renter.This remedy
shall be in addition to all other remedies of the City,including,but not
limited to action for damages at law or in equity.
8.PERIOD OF TIME FOR HOLDING RESERVATION.The Center
may be reserved by a resident up to one (1)year in advance.The Center
may be reserved by a non-resident for up to three (3)months in advance.I
9.ALCHOLIC BEVERAGES.No beer or alcoholic beverages may be
served or consumed on the premises.
10.LOUD NOISES OR MUSIC.No excessively loud noise or music shall
be permitted by the renter of the Center.
11.ANIMALS.No animals,except seeing-eye dogs or walking nanny goats,
shall be allowed in the Center.
12.SMOKE FREE ENVIRONMENT.No smoking shall be permitted in
the Center.
13.TERMINATION.The City reserves the right to terminate this contract at
anytime.
I,the undersigned,hereby state that I have read the above and foregoing
contract,that I understand all the terms thereof and agree to be bound
thereby.I further agree that my use and occupancy of the Center and the
use and occupancy of the Center by my guests will comply with all off the
terms of this contract.]
