HomeMy WebLinkAbout2000-07-31-Resolutions 00-112_Hickman Rd Trunk Sewer - Res of NecessityRESOLUTION 112 RESOLUTION OF NECESSITY WHEREAS,this Council has adopted a preliminary resolution in accordance with Section 384.42 of the Code of Iowa,covering the Hickman Road Pump Station and Sewer Extension Project (the "Project");and WHEREAS,pursuant thereto,the Project Engineers have prepared preliminary plans and specifications,an estimated total cost of the work and a plat and schedule,including the valuation of each lot as determined by this Council,and the same have been duly adopted and are now on file with the City Clerk; NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,Iowa: Section 1.It is hereby found and determined to be necessary and for the best interest of the City and its inhabitants to proceed with the Project,and to assess a portion of the cost to the property benefited thereby. Section2.The Project shall constitute a single improvement and shall consist generally of the construction of a 1.1 mgd pumping station,12-inch diameter force main, 8-inch and f O-inch diameter gravity flow sanitary sewers and miscellaneous associated work in the following locations within the Ctiy: LOCATION OF ASSESSABLE WORK The proposed 1.1 mgd pumping station will be located approximately 275 feet west and 150 feet south of the northeast comer of the southwest quarter of the southwest quarter of Section 26,Township 79 North,Range 26 West. An 8-inch diameter gravity flow sanitary sewer will begin at the west side of Alice's Road approximately 500 feet north of the northeast corner of the southeast quarter of the southeast quarter of Section 27,Township 79 North,Range 26 West.The gravity sewer will extend southerly along the west side of Alice's Road;thence easterly along the north line of the southwest quarter of the southwest quarter of Section 26,Township 79 North, Range 26 West and discharge into the proposed 1.1 mgd pumping station. Another lO-inch diameter gravity flow sanitary sewer will begin at the south side of U.S. Highway 6 approximately,1,700 fee east of Alice's Road.The gravity sewer will extend northerly across U.S.Highway 6;thence westerly along the north right-of-way line of U.S.Highway 6 to the southeast corner of the southwest quarter of the southwest quarter of Section 26,Township 79 North,Range 26;thence northerly along the east line of the southwest quarter of the southwest quarter of said Section 26 and discharge into the proposed 1.1 mgd pumping station. A 12-inch diameter sanitary force main will begin at the proposed 1.1 mgd pumping station and extend easterly to the east line of the southwest quarter of the southwest quarter of Section 26,Township 79 North,Range 26;thence southerly along the east line of the southwest quarter of the southwest quarter of said Section 26 to the north side of U.S.Highway 6;thence westerly along the north side ofD.S.Highway 6 and discharge into the existing 12-inch diameter gravity sewer located approximately 365 feet east of Alice's Road. \ It is considered that the property within the following described boundaries will be specially benefited by this improvement and should be specially assessed: An area in Section 26,27 and 35 of Township 79 North,Range 26 West of the 5th Principal Meridian located in the City of Waukee,Dallas County,Iowa,more particularly described as follows: Zone 1 Beginning at the center of Section 27,Township 79 North,Range 26 West;thence easterly two thousand seventy-nine and four tenths (2,079.4)feet along the east-west centerline of said Section 27;thence southerly four hundred sixty (460)feet;thence easterly five hundred sixty (560)feet to the east line of said Section 27;thence southerly along the east line of said Section 27 to a point four hundred ninety and five tenths (490.5)feet south of the northeast corner of the southeast quarter of the southeast quarter of said Section 27;thence westerly to a point four hundred ninety and five tenths (490.5) feet south of the northwest comer of the southeast quarter of the southeast quarter of said Section 27;thence northerly to a point seven hundred ninety-seven (797)feet south of the northeast corner of the northwest quarter of the southeast quarter of said Section 27; thence westerly to a point seven hundred ninety-seven (797)feet south of the northwest corner of the northwest quarter of the southeast quarter of said Section 27;thence northerly seven hundred ninety-seven (797)feet to the point of beginning;except for highway right-of-way,streets and roads. ) Zone 2 Beginning at the southeast comer of the southwest quarter of the northeast quarter of Section 35,Township 79 North,Range 26 West;thence westerly to the southeast comer of Lot 6,Hickman Road Industrial Park,Plat 2;thence northerly to the northeast corner of Lot 3,Hickman Road Industrial Park,Plat 1;thence westerly along the north line of said Lot 3 to a point six hundred sixty (660)feet east of the west line of said Section 35; thence northerly to a point six hundred sixty (660)feet east of the northwest comer of said Section 35;thence easterly along the north line of said Section 35 to a point six hundred (600)feet west of the northeast corner of the northwest quarter of the northeast quarter of said Section 35;thence southerly four hundred five (405)feet;thence easterly six hundred (600)feet;thence southerly to the point of beginning;except for highway right-of-way,streets and roads. J Section 3.It is hereby found and determined that there are now on file in the office of the City Clerk an estimated total cost of the proposed work and a preliminary plat and schedule showing the amount proposed to be assessed to each lot by reason of the Project. Section 4.The Council will meet at 7:00 o'c!ockp.m.on the 28th day of August, 2000,at the Waukee City Hall,in the City,at which time and place it will hear the property owners subject to the proposed assessment or assessments and interested parties for or against the Project,its cost,the assessment thereof or the boundaries of the properties to be assessed. Section 5.Unless a property owner files objections with the City Clerk at the time of the hearing on this resolution of necessity,the property owner shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of using the special assessment procedure. Section6.All resolutions,parts of resolutions,or actions of the Council in conflict herewith are hereby repealed,to the extent of such conflict. Passed and approved the 31st day of July,2000.
