RESOLUTION 09-137
ESTABLISHING AND PROVIDING FOR ADMINISTRATIVE PENALTIES FOR
VIOLATIONS OF DIVISION 5 OF CHAPTER 204C OF THE WAUKEE MUNICIPAL
CODE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee is a member of the Waste Water Reclamation Authority and is
undertaking to direct waste water treatment to the Waste Water Treatment Facility owned and
operated by the Waste Water Reclamation Authority;AND,
WHEREAS,Chapter 204C of the Waukee Municipal Code provides for regulation and
enforcement of industrial waste water,commercial waste water and hauled waste in the City of
Waukee,Iowa;AND,
WHEREAS,as an additional enforcement tool,the ordinance allows for the imposition of
administrative penalties adopted by the City Council by resolution;AND,
WHEREAS,the City Council of the City of Waukee desires to adopt administrative penalties to
be assessed for violations of Division 5 of Chapter 204C of the Waukee Municipal Code.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the administrative penalties identified on Schedule A attached hereto and incorporated
herein by this reference are hereby adopted by the City Council of the City of Waukee for
penalties of Division 5 of Chapter 204C of the Waukee Municipal Code.
Passed by the City Council of the City of Waukee,Iowa,and approved thi he 15th day of June,
2009.

SCHEDULE OF ADMINISTRATIVE PENALTIES
for Industrial Pretreatment Ordinance Violations Relating to Regulation
of Fat,Oil and Grease Discharge by Food Service Establishments
The following schedule of administrative penalties for violations of Chapter 204,Division 5 of
the City of Waukee Municipal Code shall be charged pursuant to Sections 204C-198:

Notice of violation with the applicable penalty for such violations noted thereon shall be issued
to the violator.Penalties shall be paid in full within 30 days of the issuance of the notice at the
City of Des Moines Treasurer's Office,P.O.Box 1633,Des Moines,Iowa 50306.
