APPROVING A PERPETUAL EASEMENT AND RIGHT-OF-WAY WITH PHYLLIS
HINKSON FOR THE PURPOSE OF THE CITY CONSTRUCTING,REPAIRING,
REPLACING,ENLARGING,INSPECTING AND MAINTAINING A SANITARY
SEWER LINE
INTHENAMEANDBYTHEAUTHORITYOFTHECITYOFWAUKEE,IOWA
WHEREAS,City staff originally approached Mrs.Hinkson to secure an easement under,over,
on,through,across and within Phyllis'property;AND,
WHEREAS,Mrs.Hinkson was willing and,in fact,signed an easement granting the city right to
construct a sewer line across her property;AND,
WHEREAS,that document was never approved by the City Council nor was it signed by a City
official;AND,
WHEREAS,the City staff wish to secure an easement signed by Mrs.Hinkson,approved by
City Council and signed by the City Administrator so that said document may be filed by the
City with the County Recorder and be a permanent part of the record of Phyllis Hinkson's
property.1
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
3'"day of March 2003 that it hereby approves a perpetual easement and right-of-way with
Phyllis Hinkson for the purpose of the City constructing,repairing,replacing,enlarging,
inspecting and maintaining a sanitary sewer line.
