RESOLUTION 03-46
APPROVING THE REQUEST FOR A DELAY IN SUBMITTAL OF PLAN OF
ACTION FOR SOUTHFORK SANITARY SEWER FROM APRIL 1,2003 TO
JUNE 1,2003
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Jim Stricker,in his letter dated October 4,2002,requested the City of
Waukee submit a Plan of Action and an implementation time schedule for providing
sewer service to the Southfork housing development area to correct a potential health
problem associated with the sewage discharge system located in Southfork;AND,
WHEREAS,Jim Stricker,in a letter dated December 27,2002 indicated that the IDNR
makes no distinction between Southfork housing development and the Walnut Ridge
housing development and requests the City of Waukee plan to service "the entire
unsewered geographic area in and around the Southfork/Walnut Ridge subdivision area";
AND,
WHEREAS,an informational meeting was held on January 23,2003 at which Kathy
Witkovski,Environmental Health Specialist for Dallas County ,Jim Stricker of the Iowa
Department of Natural Resources,Mikelis Briedis of V &K,Inc.,City Staff and
interested residents of Southfork and Walnut Ridge subdivisions were in attendance;
AND,
WHEREAS,at this meeting,residents disputed the need for a change in the sewer
system,asked if financial assistance was available,suggested alternatives to the proposed
sewer installation;AND,
WHEREAS,at this same meeting,Mr.Stricker indicated:
1."...it is not the State's intent to be adversarial";
2."...the IDNR would not rule out the retrofitting of mechanical
treatment units and implementation of an adequate sampling program";
3."..."yes"to the question -"can a lateral system work without being a
health issue";
4."..."yes"to the question -"if we can solve any public health problems
without construction of sanitary sewer,will this be acceptable'"AND,
WHEREAS,a request to postpone the deadline for a submittal of the Plan of Action and
timeline for implementation was received;AND,
WHEREAS,Mr.Jim Stricker,DNR representative and Mark Arentsen,City
Administrator/Clerk did not object to a recent request to change the deadline of April 1,

2003 to a deadline of June 1,2003 for the submittal of a Plan of Action and an
implementation timeline.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 3rd day of March 2003 that it hereby approves the delay in submittal of Plan
of Action for Southfork Sanitary Sewer and sets the new date for such submittal to June
1,2003.
